"Brandishing". Or possibly "Aggravated Assault with a Firearm".

Having a group of people banging on my door at 5:30am and making any sort of demands qualifies as a threat. And everybody understands this. That is why the BLM people were there in the first place.

The State does not really want to recognize a right to self-defense - especially when one is being threatened by a member of a protected class of people.

Wise move. I’m on a quiet dead-end street, don’t get many visitors except for an otherwise quiet, scowling Hussein Head neighbor every four years knocking to remind me how important it is to vote, and I agree with him with a big smile.

I wonder if the laws regarding brandishing a weapon why on your own property when you have trespassers.

I realize this is California so the law is pretty much what anybody wants it to be.

Sorry but standing inside of your home prepared to defend it if necessary with a firearm pointed down at your side is not brandishing.

Every citizen of every state in the nation has the absolute right of self defense. This man made no threatening motions or movements with the firearm but did, rightfully tell the person that he would defend himself by shooting her if necessary.

This is all about what a reasonable person would have done in the same situation. Any reasonable person who answers their door during the predawn of the early morning should be prepared to defend themselves.

5:40 AM? Probably still dark out. I’d have just shot through the door, called the police and went to sleep.

Solid wood doors are very expensive.

We recently had our mahogany front door taken down and repainted at $2000. Versus 1,000’s more if we could find a solid door replacement.

in LA Any where in California, you would have been arrested, charged with murder and convicted if you shot someone through the door. Dragging the body into your home doesn't excuse you.

Well, I tell you what.

You show up with a mob from a known violent group (and yes, I did notice that you have the lack of integrity so as to try to minimize the incident by pretending that there was only one person outside) before dawn in Texas and we will see if anything happens to the homeowner who blows your ass away.

Don’t bring a mob to someone’s home in Texas. People fear for their lives with good reason when that happens and juries are sympathetic.

I know an old man, now deceased, who confronted trespassers (who had been repeatedly breaking into his storage areas), at 3 am, on his remote property.

I think he had his 30-30.

He was convicted of brandishing, and spent at least a year in jail.

He had been a thorn in the authorities’ sides.

You drag them into the house, and then back out. You then tell the officer that you took out the trash after the shooting as you begin to clean up the inside. They don’t have a right to compel you to keep the scene undisturbed. In short, STAGE A SCENE, and turn on the sprinklers.
