What happens if a Senator or Rep is convicted of a serious crime? Example - Omar whatever her real name is, the Somalian cockroach, is being investigated for not just financial crimes but immigration fraud. Suppose she is convicted. Does she get a free pass, or other?

Interesting Question. I attempted to research that. About the best that I can say is.. even if arrested, sentenced, and thrown in jail, congress critters are still in office. Only if expelled by 2/3 vote does that change.

Chances of that 2/3 at present, are slim and none-slim was seen riding a fast horse out of DC.

Article I, Section 6 of the Constitution provides, in part: “They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.”

Asked this question elsewhere:

Prior to the 17th Amendment could states recall and replace senators? If, so the 17th Amendment needs to be immediately replaced, and or repealed.

The Ohio representative, Trafficant, the guy with the racoon toupee, was convicted and sentenced while still serving in the House. The "Beam Me Up, Mr. Speaker" guy.

I don't believe he was able to vote from his cell.

Wouldn’t immigration fraud make Omar unable to hold government office. Therefore, ejected from the House of representative’s. Don’t you HAVE to be a citizen to qualify for elected office, right?
