HOA sues retired Texas City couple for up to $100,000 for flower beds that don’t meet guidelines

A property owner’s association is suing a retired Texas City couple for thousands of dollars over a dispute about flower beds that did not meet the HOA’s guidelines.

Klaas and Dorothy Tadema moved into the Lago Mar neighborhood after their Dickinson home flooded during Hurricane Harvey.

The Tademas said they installed flower beds on the property in November 2018. They said they were notified by the HOA in March 2019 that their home improvements did not meet the association’s guidelines, which the HOA calls “covenants.”

The retired couple filed an application along with the $25 fee to get the improvements approved. That application was rejected.

I am not a fan of HOAs, and would probably never live anywhere where there was one, but if you move in, read the contract, and don’t while when they enforce the terms.

I agree with you 100%. Some good friends of ours bought their “dream home” that was part of an HOA. They’ve regretted it ever since, and are trying to sell it but the HOA is hassling them still.

For the same reason (and others) I would NEVER buy a condo or a townhouse.

Not all HOAs are the same. My experience with HOAs has been pretty good in that they at least try to keep people from trashing up the neighborhood. Our HOA is pretty laid back so I can’t say they have always been successful in their efforts. :-)

But they haven’t been out of control like the Texas City HOA in this story. It pays to find out these sorts of things before moving in ... if possible.

A neighbor who lets their house go to hell if every neighbors concern. Their is nothing wrong with wanting to get the most out of your property. If you want the right to have old cars and junk and weeds. Great. I have ni problem with that. Just don’t move i to an HOA.

Different strokes for different folks.

If an essentially same house is worth $100,000 more in an HOA neighborhood, it’s up to the HOA to protect property values.

They aren’t for everyone, but seeing alot of different communities, it’s hard to dispute that the HOA communities are generally nicer and higher valued.

Lago Mar is one of those master planned communities. Looks like the couple is merely paying to live on the community property. Nuts.

HOA, typically loaded with little people with a lot power. Never get into one of those.

Hitlers Brown Shirts were nicer people from my experience.

Dumb! Read all the HOA documents **before** buying the home. There are many advantages to being in an HOA development, but, restrictions as well.

If a person doesn’t have the disposition to be an HOA homeowner, then they should look elsewhere.

That depends.

Does the HOA that the homeowner freely and willfully signed govern which and when flags may be displayed? If so, then yes.
