It all started with a handbag.
Maryana Beyders wasnt just any ordinary bag, though. It was a pink Hermès Kelly clutch, since discontinued by the pricey French fashion house. Beyders husband had gifted her the purse, worth $30,000, as a 30th birthday present.
So after a waiter at a posh New Jersey country club spilled some red wine on the luxury handbag last year, the real estate agent sued for negligence, demanding that the Alpine Country Club pay her the eye-popping price of her spoiled handbag.
That lawsuit had already made local headlines, but on Monday, the club in Demarest, N.J., responded with a surprising move of its own: Its now suing its own employee the waiter who allegedly spilled the wine in the latest legal development after a dinner gone downhill.(snip)
Members of the club are reportedly required to pay a $65,000 initiation fee, plus $19,000 in annual dues.(snip)
In court documents filed Monday, the country club insisted it wasnt liable for the damage to her purse, the Record reported, in addition to suing its own employee.
Errico said she was appalled that the country club has chosen to take on the cross-claim, a motion in which one defendant sues another in the same proceeding.

This witch very likely has a walk in closet, garage and storage facility full of stuff.
I know I do and I have 3 storage facilities full of stuff I’ve collected over the years.
All of it quite valuable but, if it goes up in flames, that’s the way the cookie crumbles....
I’m surprised the couple didn’t file against their homeowner’s insurance and let them subrogate against the club. They would have been made whole without the lawsuit.
Hermes bags are very expensive high end collectibles. They are the Rolex of hand bags. I’m a Brahmin fan myself; gorgeous bags that last forever. Women with Brahmins can instantly recognize other Brahmins. But Hermes is the top echelon of bags and only the truly wealthy can afford them. They do not lose value over time.
A stain on the bag substantially decreases its value.
I manage multi-million dollar properties.
The club should have filed against their liability policy and made this woman whole.
Doesn’t matter if she has a closet full of these bags. Unless there is a policy in the club’s membership documents about no liability for personal property brought to the club, the club is responsible for the actions of their employees and to restore the owner to pre-loss condition.
Well, the story did remind I have(had until 30 minutes ago) a sport coat by Burberry that I loved.
Moths had taken a few bites off the back.
It looked beautiful from the from the front but, I knew people were laughing as I walked away when wearing it.
$850 gone.
However, I purchased two beautiful sport coats from Brooks Brothers yesterday and I guess at some point I was going to have to let it go.
Brahimins are beautiful.
However, the woman is still a punk.
I saw a friend wreck an Escada outfit at a party a few years back.
Somehow red wine ended up on it and she thought it would be best to clean it by jumping into the fountain of the resort we were at.
Funny as hell and she laughed the whole thing off.
I have another personal story where I did much the same thing, only because I and a friend were showing off to a bunch of women were in ...uhm...all kinds of undress at the time.
My friend I wrecked the clothes we had just purchased earlier in the day by jumping into a hot tub full of nekkid women, just so we had an excuse to get out of our wet clothes.
This chick needs to lighten up and have a little fun....
If you come over to my house as a guest or as help and spill something on my rug or coat, I have insurance to cover damages, and I will eat the deductible, unless you or the staffing company offer to cover it. It is called life.

Ultimately, If I could not take the hit, stolen or accidental, in this case, an insurance deductible, I should not be using it. In my past, I have been in that situation, and have kept items in a bank vault. That is what people do.
I understand that it was a gift of significance to the owners, however one protects oneself, and the people around one, by insuring items one cannot easily afford to lose.
A purse is normally a trivial item. to, for example, purchase a solid gold purse, is to take it out of the world of trivial and place it in the world of oh say, an art form. One has the responsibility to cover its cost of damages, either out of ones own monies or via insurance. Particularly if one is using it for a trivial purpose which exposes it to damages or loss.
Exactly. Get over it lady.
Something is worth only as much as someone is willing to pay for it. If someone is foolish enough to pay $30K, then it is worth $30K to that person. But what if the person who paid the $30K tries to resell the item? Will it again bring $30K? That is the real question, and that is when you discover the real value.

Years ago I read about a case in which a high-end Porsche was damaged in an accident (not the owner’s fault), and the insurance company only wanted to pay for the repairs.
The owner sued on the basis that the value of the car, even after repairs, was significantly less than the value of a totally pristine undamaged car. He argued that the insurance company should pay the difference in value, not just the cost to repair.
He won.
in both cases one makes sure one is insured. neither an expensive vehicle or an inexpensive one is trivial.

and if the club has insurance, her insurance company would be dealing with the club insurance company... it works that way.
