That’s an excellent point.
Well the Senate can dismiss the articles of impeachment, but it still requires a majority of the Senate to vote in favor of dismissal. Of course one assumes that would not be hard to obtain a majority. Dismissal would require 50 votes and Pence could break the tie. However, to acquit it takes only 34 votes.
