Bullies who beat third-grader unconscious won't face criminal charges, Tomball police say

TOMBALL, Texas — The disturbing story of an 8-year-old Tomball boy who was beaten unconscious at school Tuesday struck a chord with parents across the nation.

Christian Boynton, a third-grader, was ambushed when he arrived at Lakewood Elementary School, according to Kailee Boynton, his sister.

"They pinned my brother down. They were beating him. They beat him to the point of unconsciousness, where they continued to beat him," Kailee said. "They went through his backpack."

Christian was rushed to Texas Children's Hospital after being found unconscious in the bathroom.

Neurologists treated him for a brain bleed and monitored him for several hours before he was allowed to return home. He is expected to be okay.

Many on social media questioned whether the bullies who attacked Christian should be charged with assault. Others want their parents held accountable.

Tomball police say they assisted with the investigation, but determined the students involved are too young to be criminally culpable. Under Texas law, children under 10 cannot be prosecuted for committing crim

The school administrations and law enforcement kept you ignorant.

The only reason you know about it now is because of iniquitous cellphone cameras and internet sites they cannot yet censor.

When they robbed him they crossed the line, at less than ten they should be taken from their parents and psylogocally evaluated as to their suitability to be released to their parents or committed to an asylum or put in a foster home.

A few friends I went to school with, their fathers had a rule that they laid right out at the beginning: “If someone beats you up at school, and I hear that you didn’t at least fight back, when I get home, I’ll beat you twice as hard as THEY did.”

I was just thinking this over. That law just can’t be absolute. There has to be exceptions.

You mean a 9 year old can commit mass murder and get away with it?

If they cannot be charged under Texas criminal law, then hopefully they will be expelled.

I guess Texas kids are free to rob banks, carry guns, explosives, drive trucks, whatever they feel up to doing.

Not sure this is a simple attack by “Bullies”

Sounds more like an organized and planned, gang style beat down of a kid by a group of predatory young gangsters

The school is going to try to keep a lid on this, but there is absolutely nothing preventing the parents from coming forward with the details the school is trying to keep secret

the kids probably see that kind of activity in their neighborhood, family, and media...they think that everything is good and you can reset your life, like a video game or media presentation..these kids in texas were probably trying to mimic MMA or WWE or boxing or a staged movie fight.

No. Not in my school. No one wound up unconscious. EVER. And I went to a rough NYC school.

Yeah. People got beat up. People stopped beating people up with an apparent win.

I’ve seen it happen as early as second grade, and last for four years. 1980-1984.

Had a kid transfer into the school at the start of second grade and from day one most of the class picked on him and about seven or eight would beat him almost daily because he was the “new kid”, the “outsider”. I tried to intervene on several occasions, but I found myself getting my ass kicked as a result. The teachers and the school admin were indifferent.

Ran into him 20 some odd years ago down at JRTC-Ft Polk, he was a Green Beret. He thanked me for trying to stick up for him way back when.

Under Texas law, children under 10 cannot be prosecuted for committing crimes...oh well that's okay then - we'll just wait a year or three or five or however long it takes to reach an age where society finally demands that they start to take responsibility for their actions, and jail them for the first by then murder they commit at the age of being a grown up......
