It only matters what a reasonable person would think was happening. Given the publicity of the dangerous things going on in society, I think it would be reasonable to believe that your window as broken by gunfire....

Just have to have the jury believe it too.

Thanks. Maybe there’s more to the story, but apparently, the wife of the deceased didn’t present enough for a prosecution.

Yes. A grand jury in that majority Texas Chicano area might cause him to go through a trial. If he has good "insurance" (retainer service), it might be an interesting affair. From what he has said and done in the aftermath so far, that's a possibility. And if the grand jury chooses to have him prosecuted, I wonder if he might be better off putting his future at the mercy of a judge instead of a jury in that neighborhood.

Having lived in both places as a Gringo, I'd much rather be at the mercy of a west Denver Mexican jury than a Tex-Mex jury. But a black man could find it difficult in either area.

Amazing shooting, by the way, considering the likely conditions at the time. I wouldn't want to surprise someone like him with what could reasonably be seen in a flash of a moment as a life threatening attempt to attack. Maybe he was a student of the NRA, Colion Noir and a good insurance outfit. We'll see.

I find it difficult to call it road rage. We know that at least one of the two was throwing a tantrum, though.

Self-defense often looks like a hit to people who haven't been exposed to violence much, because such events often happen so fast. And afterwards, guilty parties often lie. We'll see how the incident in the news turns out, but obviously, a local prosecutor didn't find enough to make a case. Police information on these matters often goes through prosecutors before decisions on whether or not to charge.

I pulled out in traffic and a guy with his wife pulled around me and flipped me off. Murphys’s law being what it is I pulled alongside him to make a left hand turn at the next light. He flipped me off again,

He was just bragging how high his IQ was.
