No surprise there. Workplace safety incident often involves illegal aliens hired under the table, and shoddy or nonexistent safety training: don’t want those nosy government inspectors coming around, do they.
Also: what sort of business considered a storage space, which involved access via a precarious climb over big refrigerator coolers, an employee break room? “To get away from customers” — yeah, in the real working world, where there are safety regulations, that would be called a break room. But surely that sort of break room wouldn’t involve potential loss of life to access.
So, he was on the clock then, right?
