The family court judges were in different New Jersey counties, but the question prosecutors asked them was the same: Can we charge these male juveniles as adults on allegations of rape?
Judge James Troiano in Monmouth County said a 16-year-old girl who accused a 16-year-old boy of sexually assaulting her — and filming it — at a pajama-themed party should have been told by prosecutors to consider the long-term damage to the boy before she decided to pursue criminal charges against him. G.M.C., as court documents identified the suspect, allegedly sent a text to his friends that read, “When your first time having sex was rape.”
But the boy was college-bound, from a “good family” and an Eagle Scout, the judge said in his denial.

The 16-year-old girl who attended the basement pajama party told her mom the morning after the alleged attack that she feared “sexual things” had happened and that she did not understand why her body was bruised and her clothes torn, according to court documents. Her family decided to pursue criminal charges several months after the alleged assault.
About 30 teens attended the party, where both the girl and G.M.C. were intoxicated, prosecutors said. The girl had slurred speech and stumbled as she walked.
According to court documents, the two went into a closed-off, dark area. A group of boys sprayed the girl with Febreze and slapped her on the bottom so hard she found hand marks the next day.
Prosecutors said G.M.C. used his cellphone to film himself assaulting the 16-year-old girl... They said he later sent the video to friends and had sexually explicit conversations with them via text message.
In his ruling denying the waiver, Troiano dismissed G.M.C.'s alleged remarks as “just a 16-year-old kid saying stupid crap to his friends.”

When did she consent to this? So far, no evidence has been presented that these consented. Without her consent, this is rape. In order to prove she changed her mind, you need to prove she consented. If you can’t you are just making crap up. Take your fake news somewhere else
apparently they both were incapacitated and the rape charge inst aobut force, it is about age. They saw with videos and we didnt. I am assuming that after watching the video the courts think that what happened was sexual assalt and not rape.

Technically/legally rape is sexual assault, it is the same thing

My understanding is that all rape is sexual assault, but not all sexual assaults are rape.
Example, a man fondles a woman’s breast, that is a sexual assault but is not rape.
After seeing a number of young men railroaded with rape charges, I would be very careful about hanging that charge around the neck of someone. There apparently was no force.
Can you explain how a guy who finds a blacked out drunk girl, rips her clothes off, spanks her, sprays her down with febreeze, pushes himself into her, video records it, calls the video rape, brags to his friends that is was rape

And I have no problem labeling a rapist a rapist. If he was so concerned with is reputation and “good family name” he should not have raped a girl at a party. Sorry, can’t have it both ways
As for being “no force” as you describe, well, how can she resist if she was blacked out?
I read an article of a Dentist who was convicted of raping a patient of his when he put her under with some anesthesia for a dental procedure. The woman woke up with her underwear on wrong and her pantyhose she was wearing in her purse. But I guess that wasn’t rape to you, since he didn’t force her to have sex with him. She didn’t stop him right?
Not every rape is false, we need to use our common sense here to recognize, some men do rape women (and other men) and we need to enforce our laws upon those men.

The odd part of this report is that the rapist isn’t claiming he had consent, the judge was the one saying this was just what teens do.
BTW Unconscious (blacked out) people can’t give consent.
If you have to rip her clothes off so that you rip them, She wasn’t a willing participant. I never had to forcefully undress a woman, they just do that, of course, I have assisted

Just because you don’t remember something doesn’t mean that you are not liable.
Many people who have experienced alcohol blackouts are serving time in prisons for motor vehicle accidents that they have caused.
There is not enough information here but at this age in some states rape is a technical term that can mean penetration of a MINOR, not forceful penetration of an objecting or unconscious adult. She blacked out the memory of the events, she was not, according to what little is here, unconscious.

Like I pointed out earlier, I have never had to “rip the clothes off a woman”, a consensual and conscience woman will undress for you, of course nothing wrong with lending a hand :)
Drunk driving is still drunk driving.
If you believe you can get women to a point of drunkness so you can rip their clothes off and rape them so they won’t remember, then call it consensual because she didn’t do anything to stop you, then you are, excuse my french, a dirt bag.
It doesn’t help the boy’s case where he records his rape and right afterwards brags about raping the girl in the video.

there is statutory rape which is about age of consent
and that varies by state.
and there is rape that is forceful penetration of an unwilling or unconscious person.
those are the tests.
