Behind Boeing's legal offer that could leave victims families of 737MAX with nothing

The company is arguing for the cases to be moved from the US to Indonesia.

Fighting the case overseas would also most likely place Boeing under less scrutiny for its conduct around the crash, given the different legal culture and the logistical difficulty of meaningfully prosecuting Boeing thousands of miles from its US base.

In a statement to Business Insider, Boeing said its intention was to avoid a prolonged court battle "so that those affected can receive compensation without the need for prolonged litigation."

Reaching a settlement is something Boeing had privately raised with the plaintiffs before this statement.

Brian Kabateck, an attorney for 14 of the families, told Business Insider that it could prove the best way to get the relatives a meaningful amount of compensation and allow them to move on with their lives.

But rather than the conventional choice that a settlement offers — reach a deal, or see you in court — Boeing has been also pursuing a third option, which looms over the dispute.

Documents submitted to the United States District Court for the Northern District of Illinois, seen by Business Insider, show that Boeing said in March that it would propose moving the forum in which the case is heard from US federal court to Indonesia.

A decision on that point is on hold until talks with the families over settling are complete. If the two sides fail to agree, Boeing could request to move the cases as soon as mid-July.

Back in the 80’s the IRS was going after several families whose loved ones were killed in the Lockerbie 747 bombing for taxes that the IRS calculated based upon future settlements in the upper millions. The families hadn’t even received a dime, let alone any settlement offer, and it had been several years after the incident. Plus the IRS was charging interest and penalties.

I’ve never understood ‘paying off’ family members when accidents happen, even when the cause is human error etc. You fly your risk as I see it....same in car, boat and trains.

There’s something in capitalism called consumer protections. These two crashes weren’t just freak accidents. Boeing has admitted as much.

well it’s not like Boeing set out to have the plane crash to ki11 people. Quality control on any product still depends on humans before it rolls out. There is no perfection.

I agree to a point - but what about Gross Negligence? (Or what James Comey calls .... ahhhmmm ........ “extremely careless”, knew I could remember it.)

Well then that would be criminal would it not?

Gross negligence is a conscious and voluntary disregard of the need to use reasonable care, which is likely ‘to cause’ foreseeable grave injury or harm to persons, property, or both. It is conduct that is extreme when compared with ordinary Negligence, which is a mere failure to exercise reasonable care.

Boeing with FAA support, rushed inspections and self-regulated their way to get these very unsafe planes onto market. The software on these planes exist because the design of the plane is aerodynamically (and criminally) flawed to begin with. The model has a proneness to stall, particularly right after take-off, which is when both planes these crashed.

One asks, why did such a great company roll out such a flawed plane in the first place? Well the answer is, it didn’t have to. But in the name of saving time, money in the midst of Great Recession in late 2000s plus the competition heating up with Airbus: — Boeing scrubbed their initial plan to build a whole new plane and instead corrupted their existing 737 model with this madness and voila you have the 737 MAX. There are plenty of ways to research the confirmation process of the MAX planes.

Everyone is leaping to the media induced conclusion that Boeing is solely and criminally responsible for the events that lead up to the crashes. We should at least wait until the NTSB and FAA investigations conclude and officially determine what actually happened. Unexpected things can happen with a complex machine and flight crews must be sufficiently trained and experienced to respond? Were they? Was the MCAS sensor damaged as Boeing suggested by a bird or unreported maintenance damage? Why didn’t the crew that flew the doomed Lions Air plane just before the fatal flight report that they had experienced a runaway stabilizer event and had shut down the automatic trim to regain control? Did the doomed crew inspect the flight logs or do an inspection of the sensor as part of their required walk around before taking off on the doomed flight? Just because Boeing has the deepest pockets does not make it the only guilty party.
