102-year-old California woman evicted so landlord's daughter can move in: report

A 102-year-old Los Angeles woman is reportedly being evicted from the apartment she has lived in for 30 years to make room for the landlord’s daughter.

Thelma Smith received a 90-day eviction notice for her month-to-month lease in early March and is now relying on friends and relatives who live on the East Coast to help her find a new place to live, The Los Angeles Times reported.

The Los Angeles Rent Stabilization Ordinance says that landlords in the county can evict tenants to accommodate a relative, but they must start with the most recent resident. Smith, however, lives in unincorporated Ladera Heights where the laws are weaker. “They use this law to target long-term, low-paying tenants,” Larry Gross, the executive director for the Coalition for Economic Survival told The Times.

How would you feel if it turns out this landlord has lost $300 a month for the last ten years but he kept renewing month to month out of compassion for his 92 year old tenant? Still want revenge?

The people who own it should decide who live in it.

Wow.

I mean of course the landlord is completely within their legal rights...

But, I would certainly like to see them named, and shamed. If they are pretending to be a Christian then hopefully their entire church would ostracize them, if they own a business perhaps it could be named and boycotted.

Just because something is legal doesn’t make it right. Heartless folks who would do this should be outed so that non governmental societal good old fashioned SHAME can be brought into play.

I would not belong to a parish or congregation with a person who would do this, nor patronize any establishment they were part of- just as much my right as kicking the 102 year old lady out.

Month to month is a contract and if a landlord does not have his own, then it reverts to the state models .

the state took the right of choice of who this landlord can do business with.

therefore the landlord is exercising his right to move his daughter into what I would imagine is his lowest rent apartment.

I cannot blame him.

we did not renew a lease so our daughter could move into our townhouse rental. Not elderly, but family of 3 kids. We gave them plenty of notice.
My kids come first!

What the landlord is doing is legal and it happens a lot. But often the relative who “needs” the apartment stays there just long enough to meet the legal requirements, typically 2 years, and then scoots to make room for a new market-rate tenant.

While it’s all legal, the civilized way for the landlord to handle this situation would be to give the old lady some help in finding another suitable and reasonably priced place.
