That’s probably the purpose of the communication. Now if those guests repeat the same lies and aren’t challenged, a case for malice can be made.
If the malice standard is set, I wonder if it's limited. Can such a standard be applied to Democrat Congress-critters who continue to spout such malicious falsehood in defiance of the evidence that not one vote cast for Hillary became a vote for Trump due to Russian interference(no collusion took place), and can they be made to pay a financial price for broadcasting their lies?

I would pull CNN and MSNBC’s FCC license as a news organization and relabel them as entertainment companies. They lost our trust to be the peoples government watchdogs and at this point they are more aligned with Alf then with real news. They can keep their commentators on to broadcast their liberal tripe, but before each guest, they have to announce that they are liberal.
And while we are at it, they have to take NPR and PBS.
Criminal charges for conspiracy and sedition are better than a civil suit.
The irony is the media publishers and CEO’s are also conspirators in that they set policy and corresponded to promote the destruction of Donald Trump. While they can say what ever they want, they can not conspire to overthrow the government. They did of course and are as guilty as Nadler or Schiff or Brennan or McCabe.
