Not any more than Ted Kennedy was, or Gov. Cuomo and the like whom Rome manifestly considers members in life and in death.

It is not for the laity to decide who is a heretic, but the local ordinary or all the way up to the pope, and the conditions are "subject to the conditions provided by Canon Law." (CCC 2272 ) And details are what a canon lawyer of deals with in showing how hard it can be to judge whether the Pope can be judged as Committing Heresy? ("Heresy Defined ),

And what Rome does shows how she understands canon law, and which it teaches the laity every time she provides proabortion, prohomosexual public figures with church funerals.
