Declaring a national emergency will be slapped with a permanent injunction by a district judge within an hour of it’s proclamation. Will take months to get it to the USC, and it’s not a sure bet that they would lift it.

And Trump could slap an injunction on the judge or round him up in the dead of the night. It would be just as ‘lawful’

He should have ignored all of these unconstitutional edicts from the courts but his advisors farked him.

If it is a declared emergency, it might be able to get on a fast track to the USSC like Bush vs. Gore.
