Trump can still declare a national emergency after three weeks and is strongly hinting he will. That will not be a cave, and it will be up to a conservative majority Supreme Court to decide if he acted lawfully.
You need to look beyond the issue of who is winning the day’s news cycle. The Dems win today, but I see no reason why he won’t declare a national emergency- the worst that can happen is the courts stop him, but, if that happens, he can still say he tried.
