In case anyone is wondering, I checked to see what it takes to have a quorum=51 Senators.
What does it take for cloture? 3/5 Vote which is 60 if there are 100 Senators. It seems to me that the number would change, with the number present, but I’m not sure.
It depends on how the rules are written - Is it 3/5 of the Senators present? Or is it 3/5 of the Senators elected and sworn in?
At any rate, it only takes 51% to pass a bill - the stumbling block is the cloture rule, which must be passed in order to allow a vote.
That’s all I found so far. I don’t know how they can make it into a budget reconciliation bill - but that’s what Pelosi did in order to get the ACA passed and avoid the lack of 60 vote cloture.
