Former FBI Director James Comey, speaking to an appreciative audience in New York on Sunday, told NBC's Nicole Wallace that he sent two FBI agents to visit then-National Security Adviser Mike Flynn at the White House on January 24, 2017, because he figured he could get away with it.
Wallace asked Comey: "You look at this White House now, and it's hard to imagine two FBI agents ending up in the State room. How did that happen?"
"I sent them," Comey replied. The audience laughed, and Comey continued:
Something we've -- I probably wouldn't have done or maybe gotten away with in a more organized investigation -- a more organized administration. In the George W. Bush administration, for example, or the Obama administration
The protocol, two men that all of us perhaps have increased appreciation for over the last two years. (The audience applauded.)
And in both those administrations there was process.
And so we placed a call to Flynn, said, hey, we're sending a couple of guys over. Hope you'll talk to them. He said, sure. Nobody else was there. They interviewed him in a conference room in the Situation Room, and he lied to them. And that's what he's now pled guilty to.
What did he think they were coming over there for? Wallace asked Comey.
I don't think he knew, Comey replied. I know we didn't tell him.

Just read the supporting documents that Mueller gave the court. I’m not an attorney and I defer to the brighter legal minds here on FR, but I think Mueller has a real problem.
According to the 302’s that were part of the filing, it appears the FBI was already aware that Flynn was “lying” and stated in the narrative they didn’t want to confront him with “false statements” in order to not have Flynn stop cooperating.
If that is the case, and the charge stems from this interview, I think Flynn has a pretty good case for 4th Amendment violations. It’s pretty obvious they were aware of misstatements made by Flynn. They admit they were told to “use his own words” in an attempt to “refresh his memory”. So the reason the FBI interviewed Flynn was to see if he would continue the “lie”.
This shows intent by the FBI to either entrap Gen. Flynn or build an underlying case (Lying to the FBI) in order to bring leverage against Flynn to turn on Trump and others.
Again, I’m not an attorney, but I cannot believe Judge Sullivan would condone this obvious attempt to violate Gen. Flynn’s Constitutional rights.
Hopefully, a REAL attorney will weigh in on this.
He needs to be hanged for insurrection and sedition.

It’s one or the other.
The only thing that Mueller could argue was that since Flynn wasn’t in “custody”, Miranda doesn’t apply. But I would question that premise since it was a “formal” interview. I don’t think you have to be in an interview room to have Miranda apply since he was viewed as a “suspect” under USC.
Could be great legal debate though.

The wonderful part, is that if some uniform wearing city cop did that, who would jump on top of them with both feet for civil rights violations, and a pattern and practice lawsuit? That’s right, F-troop and the DOJ.
And don’t forget, Comey worked for HSBC to do damage control for it’s dope laundering problem. And HSBC of course as we all know, was founded to support the British drug trade into Hong Kong. It was founded as a dope Bank. That’s the ethics level of James Comey

I just wonder how many people out there like you realize exactly what they are seeing when the FBI admits to this stuff openly. There have to be hundreds of thousands of Americans who have been specifically trained to know it would get them prosecuted BY the FBI if they used the same investigative technique.
Same with the very concept of 302 forms. Imagine a local police department that has a matter of policy refused to use any cameras, or recording devices when conducting interviews up to and including homicide. There would be a doj takeover of that department within the week.
