The ‘Enumerated Powers clause’ has effectively been rendered mute by the 14th amendment. The Feds get to force states to provide equal treatment as defined by the whim of the Supreme Court rather than let the States run the show . The 14th was shoved down the throat of the South by not allowing representation in Congress until the Southern states voted to ratify it. It’s not, therefore , the same Constitution the Founders created and why the states need the chance to fix it.
