After more than a year of fighting FX and Ryan Murphy over her depiction in Feud, Olivia de Havilland has kept her word and is taking her case to the Supreme Court.
We must persevere and speak truth to power, the 102-year-old two-time Oscar winner said Friday as her attorneys petitioned SCOTUS in the ongoing legal battle. The fight is itself important to the principle of honesty, so much in need today in the face of deliberate public confusion for selfish agendas, she added in a statement from her Paris home (read it in full here).
Having suffered a number of legal setbacks and defeats since filing her lawsuit in June 2017, including the California Supreme Courts decision in July not to review her case de Havilland is seeking to have the nations highest court re-examine what jurisdictions in the Golden State have decided. The Court of Appeals decision is a radical departure from traditional First Amendment precedent, and benefits no group other than those who seek to use the names and identities of others in untrue and salacious historical dramas for their own profit, said , said the actress attorney Suzelle Smith of Horwarth & Smith in Los Angeles.
Are reckless or knowing false statements about a living public figure, published in docudrama format, entitled to absolute First Amendment protection from claims based on the victims statutory and common law causes of action for defamation and right of publicity, so as to justify dismissal at the pleading stage? asks the petition filed today (read it here).
FX and producer Fox 21 TV did not respond to Deadlines request for comment.
The Gone with the Wind actress asserts that FX, Murphy and Fox 21 TV never obtained nor even sought her permission to depict her or use her name in Feud: Bette & Joan, their eight-episode series about Joan Crawford and Bette Davis that aired last year. Among other issues, de Havillands lawsuit specifically targets the alleged backstage drama involving her depicted in Feuds And the Winner Is
episode about the 1963 Oscars.
Interesting Pix of RGB.
The Left’s portrayal of her as a spunky, active alert Octogenarian when she is a at best a average functioning elderly woman.
Just like the old soviet leaders whom their press portrayal as healthy and vigorous when they were merely death warmed over stiffs.
SNL would do well in the old Soviet Union as their lackeys.
At 73, I’ve been getting those for years. Especially on the back of my hands and forearms. I get them when doing work when forcing my hands into tight spaces with acute edges. As a younger man I would come away with white chafing and possibly a redening of the skin. Now I get what I call “old man bruises” that clear away in a week or two. They look like hell but cause no discomfort.
You too, eh?
Ginsburg had two bouts of cancer, which can cause puerperal lesions, as can the chemo that she took to treat it, or even age itself.
Not what I expected either.
She certainly has Errol Flynn beat beat by a country mile.
He’s half her age...
...and falling behind...
I believe she was dxd with pancreatic cancer sometime ago. I wish she & her doctors would reveal the treatment shes undergoing. Might help others dealing with same dx.
Yes, I noticed that. What causes blood lesions?
Wow, she was a stunner in her day.
“Whoever it is, will be accused of myriads of sexual peccadilloes. He or she might even be accused of spitting on the street, 36 years ago. /S “
That and tossing recyclables into the garbage.
The connection with Gone With The Wind is fascinating.
A movie about a way of life that disappeared made in a time where that way of life has disappeared.
Gettin’ old ain’t for sissies.
What’s with the doily around her neck?
One of the most beautiful women to ever grace the silver screen.
Is your knowledge from family experience or as a health care pro?
Where is the National Enquirer story on RBG health?
Best to have made the film after she passed. But who knew 102+ ?
Trump will nominate Amy Coney Barrett. After the FBI completes its investigation and the Senate confirmations are closed, DF will leak a letter to the MSM from an illegal alien who claims that Barrett forced her to work as a domestic servant for less than minimum wage. Michael Avenatti will then release a sworn statement from Barrett’s childhood friend who alleges that Barrett failed to pay income tax on the money she earned from selling lemonade when she was seven years old. Booker will cite rumors that Barrett referred to a “black person” as a black person, and Blumenthal will ask the FB I to investigate allegations that Barrett failed to brush her teeth two nights in a row when she was a junior in high school.
She’s just “pinen for the fieords.”
