Flynn Judge Fumes at Mueller, Demands Flynn be in Court Within Days for Likely Showdown; Could Flynn Walk?
The federal judge in the Gen. Michael Flynn case is fuming at U.S. Special Robert Mueller.
Judge Emmet Sullivan has scheduled a hearing for next week and directed Flynn to attend.
The judge could be perturbed because Mueller has failed to initiate a pre-sentencing report from federal probation. Such a report is the backbone of all federal sentencings and according to the court docket, should have been completed months ago.
Flynn cannot be sentenced without a pre-sentencing report where he is allowed to note special circumstances for the judge to weigh prior to sentencing.
The report normally takes months to compile.
It is unknown why Mueller has delayed the process. It is quite unorthodox.
It is likewise very rare to call Flynn — or any defendant — to a status hearing after a plea deal.
Could Sullivan vacate Flynn’s guilty plea at the July 10th hearing?
Anything is possible.
Especially when a federal judge is pissed.

That is the only non fake item. The BS about the judge going berserk is fake, totally made up nonsense by the writer who is so much a doofuse they refuse to give him a byline.
The facts in the article appear to be correct, and they are the meat of the article.
Well if you consider unsourced material supposedly describing the judges state of mind as being factual then you have a different standard for establishing fact than I do.

In fact, the reason the reason the judge set a July hearing was because he wont grant a continuance for the third time merely because the parties stipulate thereto.
It has nothing to do with a presentence report. The court could order this report on his own motiion and doesnt require the parties to agree.
Courts dont like constant continuances without knowing the reason therfore. In this case the court has set a hearing for jul 10 so that he can ask them the reason for the third continuance of the sentencing. And if he isnt convinced that the reason to continue is justifed he will deny the request, set a date for sentencing, order a presentence report and order the parties to return on the date set.
This anonymous writer is an idiot. Obviously he knows nothing about courts or how they operate. What is annoying is that some BS rag publicizes his crap as if it is fact. His so called speculation is just plain wrong. Doesnt even qualify as an educated guess.
The article states reasons for the emotions presented, building a case for them.
Emotions can be factual. They are difficult to establish with evidence, it is true. But the facts presented build a reasonable case for the emotions.
In addition, if you have followed Judge Sullivan’s history with regards to how he views this sort of prosecutorial conduct, the most telling being how he handled the prosecutors in the Senator Stevens case, his irritation makes sense.
An article is not a legal brief.
Mueller wants to drag it out, because he knows Sullivan will probably throw the case it for good.
I doubt the judge is very happy with Flynn’s attorney, either. His attorney could have had this case dismissed many months ago. Should have demanded the 302s immediately and also filed a motion to dismiss based on the unconstitutionality of the law. No one has ever been convicted of violating it and most legal scholars agree.
Just send him a million bucks for attorney fees.

His irritation stems from the fact that no one is being candid with him and he doesnt like it. He especially is not impressed with the prosecution. Or at least their lawyers. He also doesnt like that they are controlling his court calendar, not him controlling it.
Any moron practicing law knows you dont play hide the ball with the court or you will lose your credibility. It seems sullivan is getting close to that point.
