I haven't read the decision, but given the way it split I don't think it's a big deal. From what I heard on Laura Ingraham radio, I'd side with Thomas on this. Gorsuch gave a nonsense answer to the definition of "serious penalty" being one that affects life, liberty, or property, referring to language in the 5th amendment. Being deported deprives a person of none of those things, in the normal use of legal vernacular.

Thanks for your knowledgeable answer. If you think Gorusch gave a nonsense answer, I will re-think my position on this. I don’t like the idea of Gorusch giving a nonsense answer.

I tend to side with the Thomas group too. Hopefully it won’t prevent the deportation, even though it likely will slow it down.

I did scan/read the link to an analysis of the case before the decision was made. In that article it also said that the person could be deported for immoral turpitude.

I hope you are correct about it not being too bad.
