DETROIT — A spokesman says a Michigan judge wasn’t aware of a sex offender’s criminal background when he granted the man joint legal custody of a child born to a woman who said the man raped her when she was 12.
Michigan Supreme Court spokesman John Nevin told The Associated Press on Wednesday that Sanilac County Judge Gregory Ross didn’t know 27-year-old Christopher Mirasolo had two criminal sexual conduct convictions, including one concerning the woman.

Really, the judge is not a finder of fact? The judge can not ask his own questions of witnesses under oath? Can not clarify evidence? Yes, they can.

I don’t know the circumstance of the sexual encounter but the court did do this. I remember girls in Jr. High who had fake ID’s and would go to pick up bars. Better to know you have a father who cares for you than to not know or he doesn’t care.

Then that judge should be fired
From what I gather reading the article, the mother was trying to get welfare for the child, the state of course asked who the father was, a DNA test proved the guy was the father, and the judge automatically gave him joint custody without knowing the background. Why the mother didn’t speak up I don’t know, maybe no representation since she was probably just doing what the welfare office told her she had to do.

One can only speak when granted permission by the judge otherwise the judge can hold you in contempt of court no matter how justifiable your “outburst” is. And the judge will ignore your pleas.
Then let me enlighten you.

Then on the other side of the coin, approx. 5 years ago I dated a gal who had a 14 year old daughter and the ex was an alcoholic and deadbeat.
He took her to Friend of the Court in an effort to reduce his child support claiming that he was unemployed. He was granted the reduction while the judge ignored the fact that he was way behind in support payments and that he wasn't providing the daughter with health insurance benefits. At that time, he had just moved into a new house, paid for by the income he was receiving under the table..........

I read that part “kidnapped her, her sister and another girl” but the court made a deal with the guy. Apparently when a group of people don’t agree in their depositions it creates doubt. What is the rules of evidence for criminal court cases? I find the source of the information to be less than objective. You have more information not provided in this article then present it.

They did a deal because the Brown City police did not do a rape kit so they decided to bargain it down to "Attempted sexual assault.
Two years later he raped again, this time the police pulled their heads out of their fourth point of contact and did a rape kit. The underage victim in that case was told that she had to agree to the deal because, "it was just her word against his".

If there is three witnesses then it wasn't her word against his. I only know what I've read in this particular post when I posted before. I'm always skeptical of news articles.
Kiessling told the Detroit Free Press that Mirasolo kidnapped the victim, her sister and a friend in September 2008, threw away their cell phones and kept them in a vacant house for two days. She said he forcibly raped the victim at that time and “threatened to kill them if they told anyone what happened.”
I infer the three witnesses stories didn't match.
