Gingrich: Mueller Investigation 'Poisoned Fruit' After Comey Testimony

In his testimony Thursday, former FBI Director James Comey's statement about leaking information of private conversations he had with President Donald Trump revealed the special counsel investigation led by Robert Mueller was "poisoned fruit," stated former House Speaker Newt Gingrich.

Comey admitted he leaked the information as part of the FBI's probe into Russia's involvement in U.S. elections and the connections of the president's former national security adviser Michael Flynn with Russian officials.

"I asked a friend of mine to share the content of the memo with a reporter – didn't do it myself for a variety of reasons – but I asked him to, because I thought that might prompt the appointment of a special counsel," Comey testified before the Senate Intelligence Committee.

Gingrich called this "the most startling revelation" from the day's testimony, as it was a "barefaced admission" of his intent to leak the documents in hopes a special counsel would be appointed to investigate the charges.

"This statement is tremendously important because it completely delegitimizes Robert Mueller's so-called independent investigation and reveals it as poisoned fruit," Gingrich wrote in his weekly newsletter on Friday.

Session’s recusal was not a requirement by law. When did Holder or Lynch or even Kagan (SC) ever recuse themselves from conflicts? I believe you are sadly mistaken, as others, more knowledgeable than I, have stated this fact.

Good observation Mr. Gingrich. I’d go so far to say that any “fruit” from this investigation is poisoned due to the entire tree being poisoned and of course ridiculously biased.

Attaching a biased Trump loyal person to ride shotgun on the Mueller investigation would keep the investigation honest and let the right people know to fire Mueller if he steps one tiny inch out of line in his bias.

The republican leadership appears to be making one bad decision or judgment after another since President Trump was sworn in. What is wrong with these people? I get that Trump is an unconventional President but I’m sure the grown men and women in the house and senate can adjust accordingly to make good things happen. Why aren’t they?

I’m sad to say because I had high hopes for AG Sessions but he is not the right person for that job. He was much better as a Senator. Maybe another good position can be found for him within the Admin to utilize his better skills being wasted as AG. Maybe a right hand for Vice President Pence to be a go between with the senate and house.

You know darned well whose side we are on - Trump’s! That doesn’t excuse the fact that Sessions buckled when he didn’t have to. Yes, he was one of Trump’s most loyal supporters, and that was mainly because of the immigration issue. However, as an ardent Trump supporter, I choose not to stick my head in the sand and cheer when it’s clear that Jeff, to date, is a wimp. Sorry, but he is. I hope this changes and he has great things in store, but, so far - his record is a dud. He should NEVER have recused himself - that gave the Deputy AG the go ahead to appoint a special counsel - just what Comey and his butt buddy -Mueller wanted. Now, put your thinking cap on and grab a dose of common sense in this issue. He allowed this witch hunt to come down on Trump by his cowardly action.

The problem as l see it in the swamp is that it really doesn’t matter (with few exceptions) whether they’re demopublicans or republicrats.... They’re all in on the take.

Tbat’s why the estabishment hates trump.

mygosh, that's insulting. Anyone who disagrees with you lacks common sense, according to you. I'll repeat my reasoning. These bogus investigations could go on forever. I'd rather have AG Sessions not sucked in by them.

The coup is real eager to get AG Sessions out of that position. Doesn't that tell you all you need to know?

Sessions did the right thing.

Would Sessions have appointed Mueller? All part of the bigger plan and Sessions fell for it. It may not work now but still part of a plan.

How can Mueller possibly be impartial? He vetted Comey's testimony in order to try and avoid a perjury trap and it didn't work. Unless of course Sessions decides not to pursue anything on this brave honorable former FBI chief, you know the one that colluded with Hillary and lied to the public for months about an investigation of Trump. So did the Party leadership of both parties and the MSM by the way.

It’s gonna get fun when it becomes public that the DOJ got FISA warrants to dig into Comey’s communications after it became known he was leaking to the press.

One other note: He committed Perjury before the House Committee when he repeatedly said ‘We NEVER talk to or respond to stories in the press...’In response to questioning by Trey Gowdy.

Yes he was sworn in before hand along with Admiral Rogers.

“coup” is the right word. And IMO Trump is not the real target. I believe we are at war concerning these issues:
1.Big, centralized government versus limited government.
2.Socialism versus Capitalism.

Socialism made its biggest strides over the past eight years and they don’t was to lose their advances. Trump is rolling them back.

Much of what we see today we saw in the 60’s and 70’s when this country was being attacked by socialist/communist activists banked by USSR - yes, Russia. The record is clear. I was in law enforcement in those days. (now an octogenarian)

That crowd moved in, infesting our government, churches and educational institutions. Today we are paying the price for being blind to the threat. IMO this is our last chance to roll it back, or at least start scraping off the crud. If you have any religion you might say God sent us someone at the right time to save the country, a last chance, and has left it for us to support, or not support. The choice is ours.

On June 8, 2017 the Department of Justice Office of Public Affairs released a memo titled: “Department of Justice Issues Statement on Testimony of Former FBI Director James Comey”. I took the following excerpt, including the legal citation, from that statement. You can search on the above title to read the full memo.

In response to testimony given today by former FBI Director James Comey, Department of Justice Spokesman Ian Prior issued the following statement:

Shortly after being sworn in, Attorney General Sessions began consulting with career Department of Justice ethics officials to determine whether he should recuse himself from any existing or future investigations of any matters related in any way to the campaigns for President of the United States.

Those discussions were centered upon 28 CFR 45.2, which provides that a Department of Justice attorney should not participate in investigations that may involve entities or individuals with whom the attorney has a political or personal relationship. That regulation goes on to define “political relationship” as:

“[A] close identification with an elected official, a candidate (whether or not successful) for elective, public office, a political party, or a campaign organization, arising from service as a principal adviser thereto or a principal official thereof ***”

Given Attorney General Sessions’ participation in President Trump’s campaign, it was for that reason, and that reason alone, the Attorney General made the decision on March 2, 2017 to recuse himself from any existing or future investigations of any matters related in any way to the campaigns for President of the United States.

Golly gee, I see that Eric Holder and Loretta Lynch followed this to a T! Look at the date of the memo - June 8, 2017 - just a couple of days ago. It seems apparent this wasn’t effective at the time Sessions recused himself.

While the memo is dated June 8, 2017, that document is only an explanation of why Attorney General Sessions recused himself. It is not the law itself (28 CFR 45.2) which has been if effect for many years. As to the question of Attorney General Holder or Lynch, they may have been faced with a different fact pattern.

Bottom line:
(a) The law was indeed in effect when Sessions recused himself
(b) Neither Eric Holder or Loretta Lynch is the current Attorney General.

Key phrase: It is NOT the law itself. Of course,m I know that neither Holder nor Lynch is the AG. Sounds like you are a lib. Many brilliant legal minds stated that Sessions did not have to recuse himself.
