The Judge who sentenced him to begin with, is the one who should be responsible for this mess. He never should have allowed for the murder convictions to be served concurrently.

No problem:

"Malvo's case has been remanded back to Spotsylvania County Circuit Court to issue a new sentence."

Just re-sentence him to 489 years!

I can understand an age cutoff for the DP.But I'm not sure that 18 should be the cutoff age...maybe 16 would be more reasonable.

Same goes for life without parole,IMO.But again I'm not sure that 18 should be the cutoff age.Perhaps 16 would be better.

because he was 17 years old

Tough shiite. Maybe a fellow inmate will see he completes his original sentence.

I’ll never forget those two guys. Lived in terror for what seemed like months as I worked in the DC and Baltimore metro areas. This slug and that worthless Montgomery County Police Chief Moose should be hung with the same rope.

Lifetime appointments for federal judges might be the most glaring flaw in the U.S. Constitution.

When it was written, the Constitution was a self-conscious antidote to human weakness and to political and government greed.

But when it came to the Judiciary, the Founders impulsively declared their total trust in exalted beings called “Judges.”

Judge overturns life without parole sentence for DC sniper Lee Boyd Malvo

Does this mean we can execute him?

(We all know better than that.)

So basically this says that the lives of the people who were murdered by this thug are not as important as his worthless life is. I see.

Malvo appealed to the court saying he should not have been sentenced to life without parole because he was 17 years old at the time of the murders....

***
No, he should not have been sentenced to life without parole; the cold-blooded murderer should have been put to death along with his homo mentor.

This judge is an A-hole. I remember this case and it was horrifying. Those families were devastated! Maybe the state can do something but I don’t know the particulars. Maybe a Charlie Bronson can welcome him.

Re-sentence him to 500 years with parole after half of the sentence served.

Lets not be hasty in condemning the judge. He was following the rules set forth by SCOTUS. Also, the judge did not restrict subsequent rulings and if my understanding is correct, the sentencing judge can still reimpose the same sentence.

The legal point is over AUTOMATIC sentences for minors.
