14 years old - No common sense when it comes to roadways. More likely the kid’s fault. Most of the time when kids do stupid things they have no consequences occasionally the results are tragic. Since the skateboarder was running his skateboard in a public thoroughfare which already shows a lack of sense, I’d say it’s more likely the kid’s fault.

Worse, it's near 7 pm at the time of the collision, meaning it was near twilight when normal seeing is most difficult.

Sad death, for sure, but where were his parents and why was he out on the streets that late at night?
