Since the skateboarder was running his skateboard in a public thoroughfare which already shows a lack of sense, I’d say it’s more likely the kid’s fault.

Worse, it's near 7 pm at the time of the collision, meaning it was near twilight when normal seeing is most difficult.

Sad death, for sure, but where were his parents and why was he out on the streets that late at night?
