Autistic high school student raped classmate TWICE while aide napped, lawsuit claims

An autistic high school student in Honolulu raped a classmate while the adult assigned to monitor him was taking a nap, a federal lawsuit filed Monday claimed.

The autistic student had a full-time one-on-one aide because he was known to be violent, the lawsuit accusing Hawaii's statewide school district of negligence said.

The aide was asleep when the 2012 attack happened during Pearl City High School band practice, the lawsuit said.

A 10th-grade girl was in the back of the band at the percussion section when the larger 11th-grader raped her once there, and then again in a curtained area of the auditorium.

If there were people around, I’m trying to figure out how this would happen. She knew he had extreme special needs. Why was she alone with him? How was he so agile and strong? I mean, surely this is possible, but it seems difficult to achieve twice. How would she not scream if he approached her again after having raped her??

I have a better question. Instead of blaming the rape victim why was a known violent student even in the schools? This “mainstreaming” is not working. It does not bring the special needs kids up in learning, it brings the other kids down. In this case it got one raped twice.

Kid needs to be taken out and put in a good old fashion Reform School. Oh I forgot, he’s “special” so I guess that means he can get away with rape too? They knew he was violent so don’t give me any lip that’s why he had an aide who did not do their job! I seriously detest any one who defends rapists, even autistic ones.

Wow, I support your articles and always try to do justice to your threads on abortion. I am stunned that you turned on me with your detesting and your insinuating I hadn’t read the article, when, this time, I actually did. Absolutely stunned at your mean spirit tonight.

I see both sides. There are people incapable of controlling their behavior, even rape. These people need to be supervised and kept away. I’m sure you agree. Mainstreaming is wrong for kids like this, as you pointed out.

Nothing I said blamed the victim. It’s a sad situation. A year or so ago, an Orange County man was arrested for molesting a child. He was a man with later stage Alzheimers. He did not know what he was doing nor could he have. He was just reaching out and touching sexually, which is common for people with Alzheimer’s. It was the responsibility of whoever cares for him to never leave him alone with little children. People with no or little frontal lobe functioning cannot be held responsible for their behavior.

My perception of you has changed after this nastiness. What a shame. I’ve done nothing but speak for the unborn and rape victims ever in the nearly Twenty years I’ve been here.

My thoughts:

It is likely considered “rape” and not consensual because of the diagnosis of autism. She likely was cooperative.

Ok....I have gone back and re-read the article more carefully.

I am still confused. No one heard or saw anything unusual? The girl didn't report the attack to a teacher after it happened? Is this considered “rape” because of age? If it was band practice there would be so many people around that I can see why an aide would think there was enough supervision.

There is likely more to this story.

My wife taught special ed in Texas. She had a student that was extremely violent (schizophrenic), dad woke up one morning to find this kid standing over him with a knife.
Student had a tough male aide whose job was to stand over this kid to stop attacks on other students. She and the aide had to take classes on take down techniques for this student.
Why was he in school? Much cheaper than institutional care.
Wife was terrified of this 5th grade student who was as big as the high school students.
Wife quit teaching as it is a losing proposition.

A 10th grader is probably too young to “cooperate”. If she was Special Needs, it is rape.

If both of them are Special Needs, rape may be impossible to determine in this day of gender confusion. They are both victims in the eyes of the court.
