Man shot, beaten by father and son had 'terrorized' family, relative says

A relative of the father and son accused by police of shooting and beating a man early Wednesday morning (Dec. 28) in New Orleans East said the man shot had repeatedly "terrorized" her family after his relationship with her granddaughter ended.

New Orleans police say Emile Blackburn Jr., 72, and Emile Blackburn III, 47, pulled up to the 50-year-old man's Viola Street home about 12:10 a.m. The younger Blackburn walked up behind the man and opened fire, police said, striking him twice in the back of the head. Blackburn Jr. grabbed a baseball bat and started hitting the man in his legs, police said.

The man was taken to an area hospital for treatment. His condition was not immediately known.

Father and son were arrested at the scene, police said. The younger Blackburn was booked into Orleans Justice Center jail with attempted second-degree murder, court records show. His father was booked on one count of aggravated second-degree battery.

Emile Blackburn III was a New Orleans police officer from 1999 until Oct. 30, 2005, when he was removed from the force for neglect of duty, NOPD spokeswoman Dawne Massey said. He has a past conviction in 2014 for criminally negligent discharging a firearm.

Barbara Blackburn, 68, said the man her husband and son are accused of attacking had a relationship with her granddaughter. That relationship, which produced a daughter, ended about two years ago, Barbara Blackburn said. Since then, she said the man has threatened to kill members of her family.

Two weeks ago, she said the man pulled up his shirt and displayed a gun while threatening to kill her husband and son. She said the man called a family member Tuesday (Dec. 27) and made a similar threat. Later that night, she said the man tried to kick down the

Well the cops would not do anything so these two decided to take the trash out themselves. Unfortunately they did not plan it very well.

If you read the article you will see that the "victim" was a menace and thug.

Depending on the facts in the case I might be tempted to engage in jury nullification on this case if they were genuinely in fear for their lives. But normally shooting a bully from behind twice in the head wouldn’t qualify as self defense.
