Thanks for the link. Again, I think Ford was only able to do that because he was beginning his presidency, which isn’t the case here. Even so, the legality of it has been questioned.

I thought that there was pretty much always a grand jury impaneled. Not true ?

How much more crap does it take for someone to grow a pair and disqualify her as a candidate? There’s plenty of evidence showing intent, treason, fraud, etc.

Interesting. But wouldn’t an incoming president be able to challenge that legally? There wouldn’t be double jeopardy if the person hadn’t actually gone to trial.

What did Marshall mean by “it may be controverted by the prosecutor, and must be expounded by the court”?

First, that a prosecutor can challenge the pardon in court. So if Bush illegally pardons himself for Federal crimes, a federal “prosecutor” - Obama’s Attorney General or his subordinate - can therefore challenge the illegal pardons in court on substantive Constitutional grounds, namely that the President’s pardon power does not include the power to self-pardon.

Second, that a court must consider the prosecutor’s challenge. The Supreme Court could not dismiss the case as a mere political dispute, but would have to determine whether or not the Founders granted the President the power to self-pardon.

As a former professor of Constitutional law, President Obama certainly understands that self-pardons are not only unconstitutional, but also a guarantee of future presidential lawlessness and dictatorship. If Bush issues one, it would be President Obama’s obligation to challenge it in court so it does not become a precedent for dictatorial lawlessness by himself or any future president.

Even if this unlikely scenario had any validity, a pardon would not protect a President Hillary from impeachment, which she would surely face before finishing the Oath.

Obama’s goal is to be the top dog in the Demo-rat clique in DC. To achieve that, he has Lynch indict her via grand jury after election, before Trump’s inauguration. Then he pardons Hillary with certain conditions 1) neither Hillary or Bill or Chelsea can enter DC without his approval, 2) Hillary & Bill provide him all the FBI files and other blackmail data to his post-presidency staff, 3) A sizeable donation to the Obama Benevolent Initiative.

Sorry, the article doesn’t reflect reality:

1. The FBI charges no one.

2. Obama can pardon anyone for any federal crime - whether they have been charged or not - up to 12:00 P.M., EST, on 1/20/2017. If he wants to pardon her, he will, and nothing that the FBI does will stop that.

This is Bull.... Obama can’t pardon anyone that hasn’t been convicted. It will be a long process to get through all of the charges, then she gets convicted. Obama will be long gone.

As far as a Nixon type pardon. There is a question if that was even legal or constitutional. If Obama tries it then I think that this time it will be challenged. Of course with the current crew in the supreme court.....


If Obama pre-pardons Hillary, I do think we need to reexamine that policy. It isn’t kosher. A president could prepardon ALL of his friends.

So he's going to pardon her before the election? Or he's going to use the election as a referendum on prosecution and if she wins he'll pardon her?

He could just issue a blanket pardon after the election whatever the prosecutor does. I really doubt Hillary's supporters think her being indicted on the eve of the election would be a plus for her campaign.
