A month after the complex DNA-mixture evidence was tossed from the prosecutions case, an upstate New York man was acquitted of murder by a judge.
Oral Nick Hillary, now 42, was accused of strangling his ex-girlfriends 12-year-old son Garrett Phillips in 2011. Hillary was indicted in 2014, and went on trial this month.
The prosecutions case featured DNA-mixture interpretation produced by the probabilistic genotyping software called STRmix.
But Judge Felix Catena threw out that genetic just before the bench trial began, finding it did not pass the threshold for scientific validity and that it was unduly prejudicial to the defendant.

Oddly it was on both Dateline and 20/20 at the same time.
Oddly the acquittal came on Wednesday of this week and both networks were ready to air the story on Friday.
Oddly, the poor guy's name is Oral Hillary. Really? I can see why he goes by a Nick name.

I think the real reason the media took such an interest was the claim that the defendant was target, because he was...black. And, he has sued the city in a civil suit for defamation...the accusation being that race was involved.
Never mind that it is very likely this man actually committed murder.
