Rep. Jason Chaffetz (R-UT), chair of the House Committee on Government Oversight and Reform, told FBI director James Comey during his testimony on Thursday morning that the committee would refer former Secretary of State Hillary Clinton for investigation for perjury, given that she lied under oath before the House Select Committee on Benghazi in October.

What a waste of time. The FBI already said no reasonable prosecutor would indict the future queen. It’s about the target of the investigation, not the facts - and Hillary is not to be the target.

Well.... as Comey explained just a few minutes ago, Hillary was not under oath, and there was no recording made of her 'interview'.

Comey was asked if he was part of the Hillary questioning...
He said he was not...
He was asked how many agents were involved...
He said he thought 4 or 5 agents were involved...
He was then asked if he interviewed each of the agents involved...
He said no, not all of ‘em...

I am pretty sure you don’t have to be under oath to commit a crime by lying to a federal agent. (See 18 U.S.C. Section 1001 or Martha Stewart or Ali-Marri)
what still troubles me is, how would the FBI be able to make a charge that someone lied to a federal agent or obstructed justice, without some sort of proof ?
Isn't this LEGAL interview the same as a deposition ? Can anyone imagine a deposition that would not be recorded ?
Bet that was part of the agreement between the “tarmac meet up” that she would only do the FBI interview if there was no transcript of the questioning and no oath.
