Illegal gun? The second amendment make no such distinction, so there's no such thing. If he shouldn't be armed, he shouldn't be free.

He was a convicted felon, and forfeited his civil rights. Whether or not you agree with that practice, it is the practice - and Sterling had to have known that he was facing a weapons charge, once they arrested him and patted him down.
