I think Comey knew that the Justice Department (an oxymoron) would never press the case if the FBI turned it over to them. By not filing charges now, the FBI leaves the door open to have the next administration file them. Had they filed charges now, double jeopardy would apply and Hillary could never face charges for these offenses.

It is universally accepted that comey was compromised. He was told what to say at the end which were the exact terminology strangely used by obama— “ no malicious intent” and “extreme carelessness”. the chances of that happenstance are virtually nil.
