No Statute of Limitations?

Sure there is and most, if not all, the cases are past it. However about ten years ago someone brought a civil case against Cosby and the DA cut a deal. He offered Cosby immunity from criminal prosecution so he count not invoke the 5th and would be forced to testify at the civil case. This is where the incriminating testimony of his comes from.

Fast forward a decade and the current DA is embarrassed that with all this publicity they didn't prosecute Cosby back then. He didn't make the deal so he doesn't feel constrained by it and he got a judge to agree. Furthermore, they argued that since Cosby incriminated himself before the statute of limitations was up, they can still get him. And they have all that great incriminating testimony he gave when he was promised it couldn't be used against him so the case is a slam dunk.

Basically in a nutshell he was given a deal so he would waive his rights, then the deal wasn't honored and now he's screwed because they tricked him into giving up his 5th amendment rights.

I won't shed a single tear for Cosby but were I a criminal I would seriously think twice about taking a deal which forces me to testify in exchange for immunity after seeing this go down.

Criminals usually don’t have much of a choice. If they are offered immunity, they may lose ability to invoke the 5th amendment to avoid testifying. Then, if they don’t answer questions, they can be tossed in jail for contempt until they do answer.
