Crimes/Accidents Committed While High On Pot in Wa/Or/Co-Can States Be Named Co-Defendant?

Posted on 05/12/2016 8:24:11 AM PDT by Be Careful

Since these states are legislating by usurping Federal law, can they be held responsible for creating/enabling an environment that contributed to an accident or a crime?

Every state issues alcohol permits. Are they liable for drunks murdering people every year?

Can a state be sued for allowing the sale of alcohol?
Can a gun manufacturer be sued if a gun that they made is used in a crime?
Can an open carry state be sued if a gun is used in a crime?

No, Democrat politicians are never responsible for anything, except when my tax dollars goes to fund their vote buying.

Pot is illegal at the Federal level. A state’s law cannot exceed or modify Federal law.

Alcohol, guns are not illegal at the Federal level. Pot is.

Nothing close to the misery and mayhem created by alcohol

Hmmm...not finding "marijuana regulation" in the Constitution. I did, however, find where powers not specifically granted to FedGov are reserved to the States, and to the People...

Sounds a whole lot like a State's right's issue to me.

Watch out the drugatarians and “victimless crime” crowd are coming with torches and pitchforks. Never even look like your getting between an addict and their fix.

To my knowledge there is no test that can determine whether or not a person is high on marijuana so I’d say the question is moot unless an accused person states that he or she was high on marijuana.

Different way to ask the question: Can a State that allows for the selling of a product/user in their state, that is illegal in another state, be held liable for the miss use of that product in the other state.

Assume: State A allows for selling of alcohol to 18 year olds. State B requires 21 years old.

Case: a person legally buys in State A, then drinks and travels to State B and causes a loss.

Question: Does State A then have a liability for some of the loss?

I say generally no.

This is what the gun grabbers do - just replace “high on pot” with “armed” and this could have come verbatim from a Soros hoplophobic propaganda factory.

Are you kidding? The niparty is more than happy to have a drug addled population under its control.

You deserve the torches and pitchforks. Thanks to brainwashed idiots like yourself, over a trillion dollars has been completely wasted and millions of lives ruined over Prohibition, even though all the consequences were clearly predictable beforehand thanks to our experience with alcohol prohibition.

And in part, it’s your fault. In pursuing your can’t-mind-your-own-business nanny state crusade you do more evil than any pot smoker.

Correction: “niparty” should be Uniparty

True.....but still, pot is specifically illegal at the Federal level...... the US Coast Guard spends a lot of time chasing pot smugglers, by Federal law.

Just like Hillary, are ya? She wants gun manufacturers held liable for shooters who kill.

You don't often hear of people committing crimes while high on marijuana.

In two of the big problem areas associated with alcohol, domestic violence and DWI, I don't recall ever reading of someone high on pot committing a serious offense, although I am sure that this must happen sometimes.
