This was confirmed by Cruz and by representatives from every state as late as 2008 when Senator Ted Cruz was among those, every Senator, who signed Senate Resolution 511 in April 2008.
In the Senate Judiciary Committee hearings for SR 511 Judge, former DHS Chairman Michael Chertoff and committee chair Pat Leahy said:
My assumption and my understanding is that if you are born of American parents, you are naturally a natural-born American citizen, Chertoff replied. That is mine, too, said Leahy.
Later in the minutes of those hearings Cruz' Constitutional Law professor Larry Tribe made the same point, his objective being to justify Senator McCain's having not been born on sovereign U.S. soil. Every U.S. Senator signed SR 511 save John McCain. It couldn't make law, but Cruz, if he didn't agree with Chertoff or with Larry Tribe and Ted Olson, would have inserted an objection.
