So?.....Do you really really really believe that our Founders would have found Cruz eligible given his background?
If Cruz can become president because his mom was American then so can any foreign born child, grandchild, great grandchild of any anchor baby born today in the U.S. In less than a century half the world's population could be eligible to run for president.
I doubt that our Founders had **that** in mind!
No no no, please don’t try to sign me up for this anchor baby nonsense, nor do I think that jus sanguinis citizenship goes on in perpetuity.
You are trying to use a reductio ad absurdum argument that goes way off track.
The key is that every child has a natural citizenship that is tied to kinship, not to place of birth.
You can’t seriously argue that someone whose family has lived continuously in say, Afghanistan, for three generations would still be considered a natural born American simply because one of his or her ancestors was. Are you?
Vattel: “I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country. Applied to Cruz’s birth in Canada, neither his father nor his mother were Canadian. His tie to Canada was most tenuous and would not make him a natural citizen, according to Vattel.
So, where then would he have been a citizen? Cuba, which i=his father had fled and expatriated himself from? I think not. The natural link at his birth that was the strongest what that through his mother, back to the USA.
See, that's what is so cool about America. It's the kind of place where absolutely *anyone*, no matter how humble their beginnings, no matter where they were born, can immigrate here and run for President.
