Maybe the accident took place on a poorly-lit street and the tree was jaywalking.

Well the liability coverage stands...so the property owner may collect for the tree. As for the car damage itself, policies vary. Assuming the car was financed, the lienholder often requires a policy that will cover DUI incidents.
