It is not impossible that she was selling state secrets to the Russians or the Chinese. Putting them on an unsecure sever would be a much safer mode of transmission than inserting papers into holes in trees or handing them over on a lonely road. And you have plausible deniability that way.

I am coming to believe that the woman has functioned as a paid spy.Electing her president would be utterly unthinkable, like electing Barak Hussein.

If you include the Office of Director of National Intelligence (ODNI), there are actually 17 agencies/organizations.

I believe that there is also some sort of Cyber Organization that could be considered one, but the historical 16 ICs is what most people in the business refer to. You can get more information here.

I have been speculating for some time that the Clinton Foundation is nothing more than a front organization for the CIA.

If this is the case, then the whole purpose of the private server was to help facilitate CIA operations outside the scrutiny of government -- including the Defense Department, State Department, and Congress.

Nobody will be prosecuted because everyone knew what was going on -- including the White House and the Congressional committees responsible for overseeing these things.

"To do it is illegal, and to order it done is illegal."

It's even more simple than that. You need not have even done anything, simply having it is illegal. Of course, she established the circumstance which caused this information to be stored outside of a secure environment so she is culpable.

(2) Hillary wanted other countries to gain easy access to the material she decided to put on that server, but to allow that access to occur with plausible deniability.

This one is my thought exactly. I think you could not find an easier way to transfer secrets than this. You are right on the money IMHO. The Clintons are sneaky smart, but at the root they are just criminals in high positions.

Anything is possible with the Clintons. Let me throw out a more complex theory. Hillary actually knows almost nothing about technology, and is the thrall of handlers and “experts” who carry out her general desires. Some are helpful stooges, others cynical players serving their own interests. Once the private email system was in place, “other opportunities” arose both for Hillary and her satellites.
Hillary’s initial motives:
1) personal secrecy as an end in itself, her lifelong obsession;
2) needed to evade oversight, subpoenas and FOIA requests, to conceal her incompetence, criminal activity, and political/Presidential machinations.
3) needed to get off-the-books “advice” from S. Bumenthal, et al, because she didn’t know squat about foreign policy and being SoS, after Obama had banned S.B. from working for the DoS;
4) to better integrate Clinton Foundation corruption into her SoS activities;
5) to assert her “power” and contempt for others and “the system”, by breaking rules whenever she can get away with it; this was just an opportunity to non-conform.

But Hillary’s situation morphed over time. Possibilities:
1) Opportunities for Foundation corruption arose that involved letting “interested parties” have a look at specific documents.
2) She wanted to “reassure” foreign interests of her/U.S. good intentions by letting them have easy access to intel (taking a cue from FDR, who let the Soviets spy like crazy under the delusion it would reassure Stalin). Or she wanted to give them a heads up, so they could better deflect and influence Obama’s policy.
3) Some of Hillary’s handlers found H’s server very useful for their own nefarious purposes, using the same methods and means they have developed for Hillary’s machinations, including stripping out classified markings, etc. She would have no idea what her staff was doing. This doesn’t let her off the hook. She willfully created the perfect situation for espionage and back door dealing, without having the means to control it.

I am sure others can come up with variants, but my experience in life is that things change and grow out of the opportunities that the start-up creates, and are often hijacked or take off in unanticipated ways. Motives are rarely simple or static.

If nobody is prosecuted, which seems insanely possible, then the whole thing needs to be burned to the ground

Either the law applies to everyone or there is no law.

I’m sure there are senior FBI officials holding some VERY interesting backroom discussions right about now.

Go back and look at the details of the Iran-Contra affair. This seems like it was set up the same way — and for the same purposes.

The purpose of the server was to be able to operate outside of FOIA requests and government scrutiny/records requirements.

Thus any communications she had with anyone were under her complete control. Anything incriminating could be deleted. In her mind she was in charge, and as long as the other party remained quiet, she could continue to graft and grift her way to wealth. Also, we should be looking at the investors in her son-in-law’s hedge fund.

DO not for a moment think that Chelsea is immune from culpability here. She has spent her entire life and the knee of some of the worst human beings imaginable.

[...Hillary was using her unsecured server as a way to transfer state secrets to her benefit by using the excuse that the info was stolen?]

I have no doubt about that. Why would so many wall street companies pay 3/4 of a million for boring and lying Hillary speeches?

The Clintons have been funneling secure information to the Chicoms for years and years. This is why, if the FBI has the goods on this b!t¢h, they need to get it out. NOW.

Note that Hillary/Brian Pagliano had to make Hillary’s server relatively difficult to hack, to prevent leaks other than intended, and subsequent blackmail or exposure of the whole game.

If access was allowed, the specific “hackers” would have been provided information on how to get into the system. This could be complicated coding, or something as simple as giving them admin passwords, so that their access would appear to be Pagliano doing maintenance. Or perhaps Pagliano was the conduit himself — he could access the server, copy any docs he wanted (as files or simply writing down the info), and send them anywhere, with no one the wiser. Though I see the whole espionage angle as far-fetched, Pagliano’s refusal to answer questions about any of this on Fifth Amendment grounds makes you wonder. FBI should definitely be investigating ALL his email accounts, drives, and computers.

Our security department run according to NISPOM and directions out of DSS tells our uncleared employees that if they happen upon something clearly marked ‘classified’ of one level or another to “safeguard it while reporting it to the security department.”

Innocently coming by marked classified material isn’t a crime; keeping and not reporting it is.

Regardless of all these points, she never came by any of it innocently.

You make some good points that I had not even thought of. I will have to chew on this one for a while. Thanks for the new and different take on this.

You have a lot of people agreeing with you. As soon as I heard what the Clinton Foundation was up to, it was a logical suspicion.

There was a story on FR back in the 90’s that a complete cruise missle assembly line was sold to the Chinese as scrap metal. It was supposed to be broken up but was not and Bill signed off on the sale. Least this how I remember it. I won’t even go into the Loral story.
