A Queens woman died after allegedly getting trapped in a local Burger King restroom, and now, her family has sued the fast food chain.
As CBS2âs Ilana Gold reported, Shirley McCarthyâs family has also detailed what happened during her final moments at the Burger King on 82nd Street in Jackson Heights.
The incident happened on Sept. 27. McCarthyâs boyfriend, Ricardo Knox, still struggles to cope.
âI wake up every morning and it feels like Iâm in a dream,â Knox said. âShirley didnât deserve to die in that bathroom. She wanted to live like everybody else. God bless her soul.â
Knox said McCarthy, 47, didnât feel well, so she went into the single-stall restroom and locked the door. Moments later, she had the symptoms of a seizure and fell on the bathroom floor.
McCarthy could not reach the door handle, so she started screaming for help.

I do know what you are saying - both my parents were on the claim side of the insurance industry. One was in product liability for a while. So I understand what juries and sadly voters do.
Kalifornia has the same thing in new construction.
Normal seizure activity is followed by a postictal phase which can last 15 minutes or more while the brain re-boots itself and comes back on line.
This results in a out of it/lethargic person who would not be screaming for help. Something else happened.
It makes sense (in the same manner as outward-opening doors after the Coconut Grove fire).

yes I said that in post 37. After initial assumptions I realized that had to be it.
Most bathroom stalls have doors high enough that a normal-sized person could slide under the door. Kids do it all the time much to their mother’s horror at the filth they’re sliding around in.
I figured she must have been on the large side-my husband could pull me out under the door in less than a minute if needed. Hoping there will never be a need!
We were out for pizza when my boys were barely old enough to use the restroom by themselves. They came back and said they couldn’t get the door unlocked so they just crawled out underneath. It was a single stall bathroom. My broad shouldered, barrel chested husband had to crawl back under to unlock it.
If that happened to her in her home: No wrongful death lawsuit. Ka-Ching!
