Minnesota Man Arrested, Sentenced to 6-Months in Jail for Having a Windmill On His Property

Orono, MN – For more than a year, we have been following the story of a Minnesota man, Jay Nygard, who is routinely risking jail time because he refuses to remove a wind turbine from his property. Nygard has been in and out of court over the years, and despite a short-lived victory in October, he was recently back in front of a judge facing a contempt of court charge for refusing a court order to remove the turbines from his property.

He did eventually remove the turbines, leaving only the cement bases because removing them would cause structural damage to their house. This was not good enough for the local government, who ignored the advice of three different engineers and demanded that they remove the bases, despite the risk of damaging the home.

And here was a guy trying to be green, and the lefties came after him for it, with a vengeful vendetta even after the windmills were gone.

What huge hypocrites.

If it is an unsightliness issue, then he could build cellar doors or storage cubicles on the pads.

Then they would nail him for renovating or building without a permit.

Several years ago a Senator asked the Justice Department for a list of regulations, not laws, that required jail time. He wanted them broken down by level of government. The JD responded that there was no overall list and no practical way to count them. On cross the JD said that there were thousands of regulations requiring jail time.

An acquaintance was charged criminally for burning trash. The judge decided not to send him to prison as it was a first offense. But he ended up driven into penury because of fines and the state took his driver’s license because he couldn’t pay the fines. There’s even a $495 reinstatement cost should he ever get enough to pay the fines and penalties. Meanwhile, his whole family is now living off the taxpayer on various welfare. If he or his family need to go to the doctor they call 911 and ride in an ambulance to the ER.

To date, not one candidate has addressed this insanity. Jail for burning trash?

Apparently this all came about because Nygard's neighbors filed a lawsuit against him to remove the turbine.

I'm having difficulty understanding why the neighbors would care about a wind turbine. Is it noisy? An eyesore to the neighborhood?

Do the neighbors have a legitimate gripe or are they just your typical busybody neighbors from hell?

Here's a picture of the Nygard house with said turbine (look in upper right of picture). To me, it just looks like an oversized bird feeder. Nothing to be getting your panties in a twist over.

1) There are three other, much smaller wind turbines on his property. They are not the issue.
2) The one that is an issue is much bigger, and is located about 20-25 feet from his neighbor’s house. It is probably 100 feet from his other neighbor’s house
3) These are high priced, closely spaced houses located on Lake Minnetonka (wealthy neighborhood)
4) The issue is over the noise they make and the lightening that they draw.
5) It appears that the Gadsden flag is attached to one of the smaller turbines. Possible revenge against the Tea Party.

It isn’t clear how the turbine affects the foundation of his house

FWIW, from deep in the comments:
This man lives on less than 3/4 of an acre of property. He mounted a home-made, 750lb turbine on top of a 29 foot pole less than 5 feet from his neighbor's property. This contraption was noisy and reflected pulsing flashes of sunlight into neighboring homes. Do his neighbors have any rights? Would you want this thing hovering over YOUR property?

Among other things, it appears he built the structure within his 5' setback. That zoning violation directly diminishes the value of his neighbors property.l

So maybe they could try to solve it amicably and he does something to help that neighbor improve his property in some other fashion and they call it square?

He should have told them it was a priceless piece of art. I have seen similar things in front of public building that taxpayers paid a fortune for.

I worked near a row of houses in the country where one of them had a small turbine. In a 20 mph wind, the thing sounded like a police siren from 1000’ away.
