Kevin Ward Jr. was killed August 9 after he got out of his wrecked sprint car and went to confront Stewart during a yellow flag caution period at Canandaigua Motorsports Park. After one car narrowly missed Ward, Stewart drove by and Ward was struck by the right rear tire of Stewarts car and slung down the track.
Ward, 20, died of massive blunt trauma as paramedics drove him to a hospital.
His parents, Kevin and Pamela Ward, filed a wrongful death suit asking for unspecified financial compensation. The suit was filed in Lewis County, where the family lives.
Stewart was not criminally charged in the incident. On Friday, Stewart was practicing 175 miles away for a NASCAR Sprint Cup race at Watkins Glen International race track on Sunday, an event he skipped last year after Ward was killed. He also skipped the next two NASCAR events.

READ THE EVIDENCE. The “video” you saw is not what happened.
Get over your dislike of Tony (not a Tony fan here), and educate yourself on the facts. Even the DA has come out and said that Tony did not do anything wrong. Period.

Had not heard the drug part of this - actually makes me angry the kid would endanger others on the track with his drug use.

I had a first gen Rabbit that was, IIRC, 1700#. It had something like 70 HP.
There....fixed it to reflect reality.
The kid was "high" while racing, per the coroner's report.
The bottom line...Ward SHOULD HAVE NEVER LEFT HIS VEHICLE UNTIL INSTRUCTED TO DO SO BY TRACK OFFICIALS !!

I have watched the video countless times. I’ve been going to race tracks my whole life, I know people who work for Stewart - Haas Racing, and sorry to disappoint you, but you are 100% wrong.
Tony Stewart was almost destroyed by this incident, and almost left the car altogether.
We have made observations this year that he has lost some of the fire in his belly because of this.
Stewart did not intentionally hit this kid. That’s NOT the kind of person he his. He might dent your fender, or get out of the car and get in your face, but no driver I know would even contemplate this.
The Grand Jury heard 2 days of testimony, and video. They heard from 24 people there that night, and deliberated less than an hour.
Better go back and do some more research.

Yeah, Ward, by his own actions endangered other drivers (DUI), basically took his own life, caused terrible emotional damage to his family and almost destroyed (actually may have destroyed) one of America’s finest drivers.
I understand his parents’ grief, but irrationally lashing out like this at Stewart is just compounding the damage. I hope a judge tosses this out quickly so they can channel their grief in a more constructive way.
Ward got his Darwin Award.
Spoken like someone who imagines that he is so dang capable and competent that he would have seen through all the activity going on and been able to stop and offer the idiot a ride....all the while having zero experience in the arena.
That is exactly how you turn a dirt track Sprint car, it obvious you don’t know anything about dirt track racing, its called throttle steering.
Another person who doesn’t know anything if dirt track racing and throttle steering. There was no swerve except trying to turn down to try to miss the idiot walking in the track.
Its a dirt cirlce track. A driver is always turning, and if you hit the brakes, if you even have them you slide up the track. On dirt tracks you throttle steer, which means when you rev the engine it causes the back end to come out and steers the car down the track, aka away from the doper idiot walking down from the top of track.
Some thought that Stewart gunned the engine which caused the car to contact Ward.
