SAN ANTONIO (AP) — An iconic Texas restaurant chain will not allow the open carrying of guns on its properties, and industry experts say other restaurants will likely take the same stand against a new state law legalizing the practice in many public places.

Good luck to Whataburger.

The welding supply (Praxair) I used to trade with posted no CHL allowed shortly after the school shooting in Connecticut.

I think I first bought stuff from them in 1983. Over the years, I bought probably >$5K in machines alone.

I never felt the need to CHL carry in the store but I started trading with another supplier.

Today the building is vacant and has been for months.

Whataburger can become vacant for all I care.

One of the conservative legal foundations should start litigation on this issue.

If an open carry person comes into Whatchamawallmaka-Burger, what law are they violating?

Management can refuse service and tell them to leave. At that point they would be trespassing and subject to arrest I suppose.

Problem of pressing the issue would be, how would the responding police officers deal with the situation?

I wonder if Whatchamalakahalla-burger thought through that potential liability nightmare? That someone carrying legally is shot by responding officers when all he is guilty of is a (constructed) trespassing offense?

They are allowed to make their decision and customer's will make their own.

I wouldn't go into a Whataburger anymore.

Whata just lost a lot of customers

On the plus side, they have come out and stated that they have no problem with concealed carry.

I can understand - MS has open carry and I occasionally do so, but when going into many establishments, I will cover my weapon as a courtesy - not because I worry about the establishment's reaction but because there are so many nut cases who will throw a fit, call the cops and spout hysterical lies to cause trouble and inconvenience. This can be just as inconvenient for the establishment as for me.

When leaving, I often uncover on the way out the door and have done so in front of police w/o any issues (I would assume that cops would rather know up-front if one has a weapon and the locals don't blink and eye at those who carry openly).

At any rate, unless an establishment opts to ban weapons vs. asking folks not to display them openly, I will still spend my money there, with my weapon handy but covered.

We can be our own worst enemies by knee-jerking w/o thinking it through.

How is being told you cannot bring a legal weapon into a business different from a business refusing to bake a gay cake? Either a business has a right to exclude or it doesn’t. If a baker now must pay a fine for not baking a gay cake...because it is the law, then why can’t a burger joint be fined for ignoring the law that states open carry is legal. They can’t have it both ways.

A business should be able to refuse service to anyone they want. In the case of the bakers their rights have been trampled on.

If agree that the bakers have the right to control their property then it makes sense that you would agree they have the right to tell you no open carry, or no shirt, no shoes, no service if they so choose.

I'm sure this burger joint will regret their plan. It might work in NYC or SF, in Texas it sounds like a death wish for a business. Just like Chik-Fil-A boomed after the gayness ruckus.

Unfortunately it's privately held so we can't short the stock.

No matter how hot it is in Texas you won’t see the weapons I have on me.

To restate what I have already indicated, I could care less if people open carry. I like the law because prior to it if someone was concealing and they accidentally displayed the weapon that could cause them some grief. I have a buddy that was a fighter pilot that was always accidentally showing his weapon. He was 80+ years old and was always armed. He started to use a Sneaky Pete and would have liked open carry but alas we lost him recently. He was a real hero.
