An additional 76 tribes are listed as “might recognize,” meaning, these tribes may simply follow the policy of the State their Nation resides in or their Tribal Councils have yet to resolve the matter explicitly, one way or the other.
As Sovereign Nations, each tribe decides for Its People. If they wish to prohibit the color blue from being worn on their Lands, they can enforce that decree by Law. Should US Marriage Laws be made non-discriminatory towards same-sex couples, the tribes, still, may uphold their own set of Marriage Laws, much like a Foreign country might do. It could be, some Councils may move towards automatic conveyance of same-sex marriages performed on the US Territory side but not offer the licensing of those marriages on Tribal Grounds. Again, it will be interesting to watch how all this unfolds.
