Full Title: Judge dismisses libel suit by conservative video maker relating to telephone charade at Mary Landrieu's office
WASHINGTON -- A New Jersey federal judge has dismissed a libel case filed by a conservative video maker James O'Keefe, who disputed a news account of his misdemeanor conviction for trying to gain access to then Sen. Mary Landrieu's New Orleans office in 2010.
New Jersey Federal Judge Claire Cecchi ruled last week that the coverage by Main Justice, which covers the Department of Justice, and the online publication's founder, Mary Jacoby, was protected under the First Amendment because "as a whole," it "accurately portrayed plaintiff's legal standing at the time of the article."
The suit emerged from a 2010 incident, in which O'Keefe and his crew showed up at Landrieu's New Orleans office, pretending to be there to repair her telephones. The conservative, who is known for undercover efforts to expose mostly Democratic and/or liberal targets, reportedly was out to show how the senator's staff handled calls about the Affordable Care Act.
O'Keefe, in his lawsuit, said the article in Main Justice and subsequent story was inaccurate because it falsely suggested he and his crew were trying to bug, or tamper with the phones. The suit suggests Main Justice was "sharply and politically opposed to plaintiff's activities as a journalist."
