    Reading that headline I thought Oklahoma was against the mascot due to the gun and that this was a leftwing over reaction towards guns. What a surprise the story was about only the similar looking mascot!!

    I wouldn’t sue, except to make the copycats change their name to the COPYCATS. How pathetic, just like the new name!

    OSU must be concerned about the IQ of their fans if they think that the two mascots might confuse anyone. Please note that I didn't say anything about OSU fans' IQ; just a supposition about the school administration.

    IQ has nothing to do with the basic legal reality that failing to defend a trademark, logo, or name results in the undefended item falling into standard use and losing any legal protection. Witness aspirin, Xerox, etc.

I think Xerox actually hung on to their TM... http://en.wikipedia.org/wiki/Generic_trademark
I remember in the 70s and 80s when Xerox would show up in courtrooms and file briefs when they saw the use of “Xerox” in place of “photostatic copy.”
But it was expensive and a lot of work for them.

    This happened a few years ago with NC State University and the University of Nevada.

 
There was an even more recent case with NC State and Loyola University in New Orleans.
