Statutory rape victim reportedly forced to pay child support

PHOENIX — A man who slept with a 20-year-old woman when he was 14 — and didn’t learn he was a father until eight years later — is now being forced to pay child support, the Arizona Republic reports.

Olivas, who said he was confused and going through a rough patch at that time of his life time, said the two went their separate ways after the encounter.

Arizona law says a child younger than 15 cannot consent to sexual relations with an adult under any circumstance.

All of it was put behind him, he thought, until two years ago he was served papers from the state demanding he pay child support.

He’s not paying for the rape. He is paying for his daughter.

Once again, if a 14 year old girl is raped and she doesn’t put the child up for adoption, she supports the child.

Not really. A 14 year old rape victim with a child (unlikely, but possible) would be eligible for WIC, SNAP, Section 8, TANF, subsidized childcare, possibly unemployment & SSDI, Obamaphone, Meals-On-Wheels, food banks, Pell Grants, student loans, head start, PROMISE JOBS, JTPA, Job Corps, VISTA, AmericaCorps and dozens of other programs, in addition to help from her family and child support from the rapist. But you want a rape victim, because he’s a male, to pay out the nose towards the fruit of his victimization. Beyond unbelievable!

If he was still 14 and took custody he would be eligible for all that too. But he’s 20 and he has a daughter and he should support his daughter.

Now if the mother was making tons of money, then I’d say no. But my guess is that he already makes more than the mother, even though he’s 20.

He’s got a daughter. That’s not a bad thing.

You really can’t be this obstinate. I’m thinking you’re paying the “devil’s advocate” or something. A) No he wouldn’t be eligible for those things, it doesn’t work that way. (B) Men don’t get custody, didn’t you hear me say that in previous posts (C) he doesn’t have a “daughter” but rather there is a six-year-old child that was created by the fact that he was raped by an adult. That’s not on him and the fact that the state of Arizona is going ahead with this (as most states would, they don’t want to pay the rapist/mother benefits) shows you how far we have fallen. Real justice would consist of the victim (the 14 year old at the time) getting on with his life with some free counseling paid for by the state & restitution from the criminal, the rapist spending the appropriate amount of time in prison for statutory rape and possibly child abuse and sex crimes and the product of that rape being adopted by a couple. Remember: That rapist abused a minor child sexually. Should another minor be in the same home and be raised by that child molester?

Never having had the experience of being been taken by an older woman (when I was a minor) I have no idea how traumatic it might have been. I suspect it may not have been as traumatic to a boy than to a girl, being that there are differences between the sexes (forget gender), most important of which only females can get pregnant and the natural readiness of males (even teens) to have sex without preliminaries or emotional involvement.

i would be devastated if this had happened to either of my sons... i might even go crazy on the offender... i do not believe the guy should have to pay child support... what effin' gall the gal has...

according to Dr. Drew, studies show that these types of relationships do negatively effect the boys involved in the long run...

It doesn’t matter how the child was created. He is the biological father, so he helps support the child.

I’m no expert on child molesters, but I wouldn’t expect that the mother would be a threat to her daughter, even though she had sex with a 14 yo boy when she was 20. I’m sure the state has experts and appparently nobody is crying foul.

No, no, no and no. You’re warning people on another thread about the “dangers” of e-cigs, but you see no problem with child molesters raising children and receiving a gratuity from the victim for raping a minor? Confused much?

So you think a RAPE VICTIM who was a CHILD at the time should pay child support because his RAPIST/CHILD MOLESTER became pregnant as the result of the FELONY CRIME she committed and I somehow sound harsh and indifferent? Is that what you’re saying?

It was statuatory rape, but unless she forced him, it was still his decision, even if he was only 14.

You do not understand. Statutory rape laws exist to protect children even from their own stupidity. Example: even if a 14-year-old girl actively tries to seduce, say, her stepfather, the stepfather is legally a statutory rapist if he acts on it. The law draws a line usually at 16, and says that a person aged 14 is unable to give informed consent to a sexual act with someone of legal age. Young adolescents are not considered to have adequate judgment about the possible negative future consequences. They can't enter contracts for similar reasons.

In this case, it was a teen male who, regardless if he pursued or enjoyed the sex at the time, was unable to give legal consent because he was underage. Obviously, if he could have foreseen these consequences, he might have found a way to resist; but we don't know: he could have been plied with alcohol or drugs, as is often the case with sex predators.

For the state to now demand that he pay child support to his rapist compounds the negligence of the courts that should instead protect him from her predation. She should be jailed and the child custody given to social services to sort out.

Perhaps he could take custody along with his parents or other relatives, but at least he would have a writ of legal custody and some control over his fate instead of being financially raped by the state on top of the other rape, but no say in how the child is raised.

Although the initial reaction to underage sex with an older seducer is different for boys than for girls, research has found that it also harms boys because adults are supposed to have better judgment than to lead the boy to do something he is fairly sure his family would object to. There is a power imbalance that makes boys feel taken advantage of on some level, even if they enjoyed the physical experience at the time. If the relationship continues, the sneaking around and secret-keeping damages his relationships with his own family as well as his character development.

When the news gets out among his friends, teachers and family, their wide range of reactions also affect the boy -- classmates may high-five or bully, and everything in between; teachers and parents may exhibit everything from neglectful indifference to outrage, morbid overprotection or punishment. The seduction's aftereffects also distort his ability to form a solid future relationship with an age-appropriate female.

Also, the experience of being seduced or raped predisposes a male child to a greater statistical likelihood of becoming an adult who seduces or rapes, regardless of how thrilling the adventure may have seemed at first.
