Kenneth Qualls claims he had permission from on high to give the toddler a $2,500 public urination ticket in November 2012 after the boy began to pee in front of his house.
An Oklahoma cop canned for citing a 3-year-old boy for peeing outside is now suing the city of Piedmont for unfairly flushing his career.
Kenneth Qualls claims he had permission from on high to give little Dillan Warden a $2,500 public urination ticket in November 2012 after the tot unzipped in his pants on Ryan Drive.
The prohibited pee was on private property, the boys mother, Ashley Warden, said at the time.
"I said really, he is 3-years-old, and [the officer] said it doesn't matter its public urination, the boys grandmother, Jennifer Warden, told KWTV News 9 at the time.
But about 10 days after the ill-advised ticket, Qualls was dumped from the department, The Oklahoman reported.

During the 2012 pissing match, the officer was even called stupid by the citys mayor, furthering muddying his reputation, the suit claims.

You do realize that the fact he even bothered to ask says a lot about who he is. The only question is, should they also go after the guy who said it was OK? If this guy has no more discretion than that, he does not belong as a cop.
As for “permission on high”, I hope he has a lot more than that statement to back it up.

IF....and that’s a big if, he did have permission it
would have been in the form of a radio call to HQ
where he would have asked the watch commander if he
should cite or not. And if said shift supervisor actually
did tell him to do so then it is the shift supervisor
who should be held accountable. And IF said conversation
actually occurred it should have been recorded as virtually
ALL agencies record their radio traffic. Should be fairly
simple to confirm or deny the allegations.
I thought you were going to say you lived in the country so no little boys would pee in your yard...but sadly no, that wasn't the reason.

Live stock and pets pee out side all the time only in crowed urban areas is it a worry.
I am sure my son pee in the yard and woods a lot when he was little to much time wasted to run back into the house.
