A desperate father has been banned from seeing his young son for four years after he was found with an unloaded gun he legally owned in the back of his car among his possessions as he moved house. Brian Aitken was arrested in 2009 as he was moving back from Colorado to New Jersey to be near his child after a divorce. He was later convicted of possessing a gun and sentenced to seven years' prison. Now the New York University graduate and digital media entrepreneur is using a crowdfunding website to raise funds so he can write a book about his ordeal and hopefully be reunited with his little boy. The saga began when Aitken's mother called 911 after he arrived with his possessions piled high at her house in New Jersey, but she didn't complete the call. The police arrived regardless and after questioning her she explained that she was concerned for Aitken's welfare following his divorce.
The officers then called Aitken, who by that stage had left, and coerced him to return. When he arrived, the officers searched his car and found three locked, unloaded handguns in the trunk. He was then arrested.

Not even in Britain would something as retarded as this happen. The maximum sentence for possessing an illegal firearm in Britain is 5 years, and if legally held but carried in an unsecure manner in the back of a car, the most they could expect to happen is that their firearms certificate would be revoked, they would almost certainly not be imprisoned.

So me... owner of a NC CCW... married father of five... never had more than a traffic ticket... happen to be driving in New Jersey with a pistol... spent 7 years in prison with rapists and murderers.

Warrant? We don’t need no stinkin’ warrant.
Maybe unlawfull carrying of a weapon and 2 years probation but 7 years jail time!! WTH is wrong with that prosecutor?! Put him in jail for awhile so he sees the consequences of his irresponsible and vindictive prosecution methods. I’m guessing most (not all) silver spoon attorneys are devoid of compassion because they didnt feel enough pain in their own lives growing up which was attributed to their shielded upbringing with plenty.
Cops in NC are different. I have shown my CCW numerous times to traffic cops or approaching copps that might see me carrying. City, county and state troopers alike. They send me on my way to have a nice day. A few even compliment my gun.
My brother and I are under the asssumption that the reason I got a warning for speeding in a school zone last month was because I had a CCW. Police here actually appreciate law abiding carriers.
This is one of the many reasons I would never ever ever live in a liberal metropolitan area....
The missing something is the wife, I think. She called the cops. So you have NJ looking to protect the wife from the allegedly crazy husband, using "gotcha" state gun laws and her stated fears. It's an extreme example of the common policy that any domestic problem can lead to serious impairment of gun "privileges" in many states.

But what was exigent that gave them lawful and full access to his vehicle with no warrant?
I think he was being too open and honest and logical with the cop.
Unfortunately, that's a procedural question. The police can violate your civil rights (unreasonable search/seizure first, 2A second, and I'm not sure what with family separation), and you can appeal.
That's the check written into our laws. Unfortunately, it's not frictionless. It's expensive and it takes years.
The government agents, and the spiteful wife, both know that.
But as the FR jackboot lickers insist the cops are "on our One wonders if he gave consent to the search. BAD IDEA
