Sandcastles? Verboten! Obama Boots Kids’ Sandcastle Contest off Beach

If you thought the Shutdown Follies couldn’t get any more absurd and spiteful, you were quite mistaken.

It was announced today that an annual sandcastle contest on San Francisco’s Ocean Beach has been cancelled out of sheer malice by the Obama administration, despite the fact that the beach on which it is held — part of the Golden Gate National Recreation Area — normally has no lifeguards, no rangers, is permanently open to the public, and requires no funds for day-to-day operations:

So the man who was going to stop the oceans from rising is afraid a few sandcastles getting washed away will show he hasn’t yet accomplished this promise either.

Apparently, America IS a nation of cowards. HOLD THE DAMN SANDCASTLE CONTEST ANYWAY! I would like to see Rangers or National Guard try to billy club little kids building sand castles.

Know the law.

The most common way states determine where to grant public access to their coasts and beaches is by applying a concept based on the mean high tide line. In most states, all land below the mean high tide line belongs to the state and citizens have the right to unrestricted access to that land. Intuition would indicate that this “line” is where the sand changes from wet to dry during high tide. This, however, is not always the case. The mean high tide line is actually the arithmetic average of high-water heights observed by the National Oceanic and Atmospheric Administration (NOAA) over an 18.6-year Metonic cycle. It is the line that is formed by the intersection of the tidal plane of the mean high tide with the shore. It is not an easy line to determine, and it is an even harder one to see. From standing on the beach watching the waves, there is no way of knowing exactly where the mean high tide line falls, or where public land begins and ends, making enforcement a difficult and controversial task.

The coastal states of Delaware, Maine, Massachusetts, New Hampshire and Virginia use the mean low tide line rather than the high tide line to demark the boundary between private and public property. These states do not own the intertidal zone of their beaches, and therefore private property owners can own land all the way down to the mean low tide line. This line is also determined through NOAA surveys of the average low water mark over an 18.6 year period. In these five states, the intertidal area is not necessarily privately owned along the entire coastline, but it may be. In the states of Maine, Massachusetts and Virginia the vast majority of the coast is privately owned. In Maine, intertidal land is presumed to belong to the upland property owner, unless legal documentation proves otherwise. In Delaware, the property boundary between public and private lands varies between mean low tide, mean high tide, and a meets and bounds description on a deed, depending on the location along the shoreline. In New Hampshire a distinction is made for water access depending upon whether the beach is state owned or maintained.

Of course, building sand castles below the mean water line, makes for a very short window for the contest to occur.

Hmm, they even had a permit that was revoked. I thought that was the ostensible reason for flooding the national mall with illegal aliens. The illegals had a permit, and it was only fair to honor it. Guess the rangers in Cali didn’t get the memo.

As more and more of these stories come out, Obama and the Dems sink lower and lower in the polls. They are the one being seen as mean, petty, childish, arrogant, and dictatorial.

In other words, they are finally being revealed to be the dicks they have always been.

That park doesn’t belong to Obama, Reid, and Pelosi: it belongs to the people. What these a-holes don’t understand is that wth every one of these stories, they are just showing us how little we need them in our lives!

In most cities and most states, I’m guessing that a decent, generous private owner of beachfront commercial or residential property would come forward and donate the use some of some of their beach to this activity-but I guess not in California...
