A devastating letter sent to the family of a teen with autism is hateful, but not a hate crime, police say.
Despite the hateful language used, the Crown Attorneys office has advised that the content of the letter falls below the threshold for a hate crime, Durham Region police said in a statement Tuesday. However, there are other Criminal Code issues that are being considered.
The criminal code defines hate propaganda as a statement that advocates genocide, publicly incites hatred, or wilfully promotes hatred.
Although the message in the anonymous letter has been spread widely by concerned family and friends, the fact that the offensive screed was addressed to one specific family makes it an improbable hate crime charge, lawyers say.
If you cant show that someone has published broadly, then are they really trying to promote hatred or are they just being a nuisance to the poor parents? said lawyer Philip Tunley, speaking generally, and not about specific facts of the case. Its a tough one, but thats the kind of thing a Crown attorney would look at.
On Friday, Brenda Millson, the grandmother of 13-year-old Maxwell Begley, received a letter in the mail at her Newcastle home. The anonymous writer, who claims to live in the neighbourhood, complained about the noises the teen makes when outside and wrote that the teen was a hindrance to everyone.

What is the sense of having any hate crime legislation? For political correctness expediency? To make the liberals feel good?
When has ANYONE ever been charged with a hate crime?
Good thinking!
Thought police suck no matter what thoughts they are policing.
If I want to hate someone, it is my right.
If I want to expose my hateful self in the form of a letter, it is my right.
They can do what they want in Canada, but in America we should stick to punishing crimes and not emotions or ignorance.
That’s awful! I thought they were cracking down on bullying, but I guess just for some people.
I’m going to step out on VERY THIN ICE here.
I have a very deep aversion to kids who SCREEEMMM! (And so do a LOT of people.)
I know, a lot of parents think that everyone should love their little dears as much as they do.
But in the last 10 years of so, most parents seem to think that their little darlings can do ANYTHING THEY WANT, ANY TIME THEY WANT and if you don’t like it, why how RUDE ARE YOU?
An autistic child is what he/she is. They are NOT the problem. They do what they do and can be VERY ANNOYING to those around, especially if the parents are “discipline adverse” types who let their little precious do whatever. (Miracle Worker)
I understand that parents of autistic children love those kids more than life itself. But that does NOT excuse them from structuring the child’s behavior to conform, as best as possible, to normal life.
OTH, there are a lot of people who do NOT share this attitude. And they forcing the rest of us to “like” their child is no different than queers who think we all “need” to “understand and like” their lifestyle.
Once upon a time, folks had this thing called “consideration” for those around them. Parents would take a tantruming child OUT of the restaurant in CONSIDERATION of those around. Parents would take their screemers out of church, in CONSIDERATION of those around them. And on and on.
Now, CONSIDERATION is not even in the equation. I love my kid, and so YOU SHOULD TOO. And you should put up with my kid running riot in the store, restaurant, neighborhood because “MY KID” is “SPECIAL.”
I grew up in a farm district that had a disproportionate number of severely retarded and deformed children. Probably fertilizer, pesticides and/or whatever else.
As kids, we all had respect for those unfortunates. But their parents had RESPECT for all others around. It was a TWO WAY STREET.
It isn’t the autistic child that’s at fault, its the idiot parent who thinks he/she is “entitled” to make the “village” accept the child, lack of parenting notwithstanding.
It does NOT take a “village” to raise your damn kid. It takes a RESPONSIBLE adult who has CONSIDERATION for those in close proximity.
We do NOT know both sides of this story. But it seems that maybe, just maybe, the parents are NOT very responsible, and let their little darling terrorize the neighbors. Just something that should be CONSIDERED.
Where else would such vitriol come from?
Now I’ll stand by and watch the flamers and “new age” collectivists try to bury me.
I think that the woman who wrote the letter saying they should euthanize the boy is suggesting MURDER. She should be convicted for that alone.
In addition, she should be asked if she, herself, would commit the crime if it was her own child.
I have had so really trying times in my life... when you are at complete wit’s end... always remember to be kind. Karma or whatever people of faith may call it, does exist.
This should be in news, not chat.
For non-ping Canada list!

You are entitled to peace and quiet in your neighborhood!
Would any of the Freepers here defending this kid take it if some inconsiderate lout put their dog out to howl and whine all day? No they would not. There would be posts urging the afflicted to call the police and the humane society to turn said lout in.
Time to call complaints in to the police and child welfare.
Canada Ping!
My BS Meter has been twitching since I read this story.
I wonder what’s meant by “noise polluting whaling”.
Let me guess. White?
You are pointing out all the evidence of the self-absorbed culture we have become. “Virtues” of kindness, consideration, respect, empathy, and a sense of obligation are all out the window.
Anything goes as long as it goes “my way” is the modern life philosophy... and it gets worse every day.
Remember how we all felt on and after September 11, 2001? How long did that really last before everyone was back to their old selfish ways? Everyone is back in front of their computers updating their Facebook status. Catching up with Kim Kardashian and Honey Boo Boo... complianing that they can’t get a job, and wanting Obama to bail them out of their outrageous student loan debt...
It’s tiresome.
Dare I say it and trigger the not-so-passive NSA “chatter detector bots”... but maybe it’s high time for a humiliating reminder from the people that hate our nation just how ignorant we are.
Gotta go... sounds like someone is at the door... trying to kick it down.
“I understand that parents of autistic children love those kids more than life itself. But that does NOT excuse them from structuring the childs behavior to conform, as best as possible, to normal life.”
The kid was playing in his Grandmothers backyard during daylight hours.
All kids make noise. My autistic son made more noise than most kids and it was the same kind of noise the kid in this story makes.
My position is it’s no more annoying than neighbors who mow their lawns at 8am on Sat. or Sun morning.
Kid was in his grandmothers private backyard. Neighbor doesn’t like...too damn bad. Plenty of things “normal” people do annoy the living hell out of me.
you should’ve threatened a big money lawsuit and you were going to sue all the parents. Then say, “see you in court.” You will see how fast they take it down. People fear losing money, not getting a black eye. also threaten to sue the school for negligence for ignoring bullying and allowing harassment of your son to continue. money talks.
I read the letter. I wanted to vomit.
I have a 12-year-old autistic daughter.
She cannot speak, she is not potty trained. (Lord knows we’ve tried.) She does like to go outside, yet she doesn’t ‘scream’ or yell loudly.
I do not know what the woman who wrote that disgusting piece of satanic filth believes, but I can guess it is likely she is NOT a believer in Jesus Christ. All I can do it pray for her.
For some, it’s all about ‘me, me, me.’ Compassion, love, and (the right kind of) tolerance are foreign concepts to many these days.
